TAPPET
February 19, 1985
Board of Selectmen
Town of Mashpee
Town Hall, Central Road -'
Mashpee, MA 02649
Re: Patrolman David T. Aitchison
Gentlemen:
On February 6 , 1985 , you drafted a letter to Patrolman David
T. Aitchison. After he received it, Mr. Aitchison forwarded it to
this office where it was received late last week. In this letter,
you advised Patrolman Aitchison that at 7:00 P.M. on Wednesday,
February 27, 1985, the Board of Selectmen would conduct an open
hearing to consider the termination of Mr. Aitchison ' s employment
as a member of the Department of Police of the Town of Mashpee.
Needless to say, Mr. Aitchison objects to this hearing and wishes
to be represented by competent counsel .
For more than five (5) years, Mr. Aitchison has been represent-
ed in this affair by Attorney Edward E. Veara. With only a few
slight exceptions widely interspersed, Mr. Veara has handled this
matter entirely on his own, and he is the only attorney who is com-
petent to represent Mr. Aitchison at the hearing you intend to hold.
Unfortunately, Mr. Veara is on vacation at this time. It is unlike-
ly that he will be back in the office until the day of the scheduled
hearing (which would not allow him adequate time for preparation) ,
and it is certainly possible that Mr. Veara will not be back until
after the day of the hearing.
Especially when cases involve potential Civil Service appeals,
Attorney Richard L. Zisson will sometimes assume representation. Mr.
Zisson, however, will begin a lengthy jury session in the Federal
District Court for the District of Massachusetts on Tuesday, February
19 , 1985 . Even in the unlikely event that this jury case should
conclude in time to allow Mr. Zisson to appear at the Town Hall on
t
ebruary 27, 1985, he will not have time for adequate preparation.
e does not know anything about the background of this case, and at
he time this letter was drafted, he did not even know such a case
existed.
