Mashpee Selectmen <br /> Page -2- <br /> 2/19/85 <br /> Z t S S O N A N O V E A R A <br /> Finally, I must add that I have other commitments myself <br /> on February 27, 1985 , and I would hardly be able to represent Mr. <br /> Aitchison in this matter in any event . <br /> Because of the foregoing circumstances, I must request <br /> that the public hearing be rescheduled from February 27, 1985 to <br /> 7: 00 P.M. , Wednesday, March 13 , 1985 . <br /> In another section of your February 6, 1985 letter, you <br /> advised Mr. Aitchison that the Board of Selectmen intended to ter- <br /> minate Mr. Aitchison' s regular compensation under Massachusetts <br /> General Laws Chapter 41, Section 111F, as amended. As I indicated <br /> in my previokis letter, Mr. Aitchison believes this action is <br /> unlawful andlhereby registers . his formal protest with you. Should <br /> you not reconsider your decision (which has apparently already gone <br /> into effect) , Mr. Aitchison will file a ,complaint in the Barnstable <br /> Superior Court, and he will seek preliminary injunctive relief. He <br /> will not request an exap rte temporary restraining order. In other <br /> words, the Board will be served and will receive notice so that both <br /> sides will be represented in court before the Superior Court justice <br /> makes his determination. Nevertheless, it is possible that this <br /> matter will be argued in court before the middle of March if the Board <br /> does not suspend its Chapter 41, Section 111F decision at least until <br /> the time of its public hearing. <br /> In any case, I again repeat my request that your public <br /> hearing be postponed to March 13, 1985 . <br /> If you should have any questions about this matter, please <br /> feel free to contact this office. <br /> Cordially, <br /> �� <br /> Paul V.
