Frye <br /> -_ Ch ef-of-Police- ---- ---- -- - — <br /> Re: Arrests Involving Driving While Intoxicated <br /> I. Purpose <br /> To establish Departmental Policy and Procedures for arresting <br /> persons on a charge of driving while intoxicated or driving <br /> under the influence of intoxicating liquors etc. <br /> II. Policy <br /> A) The officer, following whatever initial examination at the <br /> scene of the traffic stop he believes necessary, will effect <br /> a physical arrest of the subject. <br /> B) Chemical test(s) or analysis of breath or blood will be of- <br /> fered to the subject in accordance with M.G.L.A. Chapter 90, <br /> Section 24. <br /> C) The officer(s) shall process the subject (arrestee) pursuant <br /> to all applicable federal and state laws and department book- <br /> ing procedures. <br /> III. Procedure <br /> A) From the moment an officer suspects a driver of being under <br /> the influence, he shall record his observation. <br /> B) Exercise care and caution in pursuit of a drinking driver, <br /> and summon adequate assistance due to the unpredictable re- <br /> action of many drinking drivers. During the pursuit of the <br /> drinking driver, the officer will be alert to the driving be- <br /> havior of the violator. <br /> C) Pursuit should not be prolonged. There is a degree of urgen- <br /> cy in getting the drinking driver off the road. <br /> D) Stop the violator in the safest possible location. <br /> E) Once stopped, do not allow the drinking driver to drive any <br /> further. <br />
