It says the _consultant will be . But now the
consul tal s a cor or*at i on and that I dory' t know -what k i nd of
assets this corporation has, I don' t know if it has any i n uranc.e..
or not and I felt that I better call that to the attention of :. 1,e'_..
Z.
Board because i you dere relyingu orpersonal re re ent i10
n _ .rr! .
based
{
upon your personal dealing with Dr.. Aubrey that would
b the with a corporation present . would indicate .
that ah I endeavored to contact Dr . Aubrey on Monday and he `1 'r-0

returned r call on Tuesday and poo a to i . And on Tue d Y +
he indicated to rye than he ha.d successfully obtained insurance
l i abi l i t insurance , i n the amount that was originally set fort
in the original agreement,. And in speaking to him, I
congratulated him and thought that was very good. And he then
n..
stated to me ah that he didn't see that it was necessary that
he didn't state this o rate discussed the fact that given
,._.;.. _
the fact that he now had insurance we really didn' t need the-
addendum
he ddendu any longer. We could go right on with the original
policy (ah the original contract as presented which required the --
consultant to furnish a liabilitypolicy and since he had it, no :}
problem. There's a corporation in place now. Let him sign it a
a corporate entity and furnish policy of insurance. That aspect
of this thing is resolved to my satisfaction h with the cia
that I would want ah as again , a standard operating practice, F
to have some form of proof of the insurance polic i Oren to the
town and filed with the document . Ususally khat is given is a
so—called binder , l think , as Jean referred to it as, A binder
is something you get when you first tae a policy out . Actually,
proof of insurance usually corner . . . there is a regular fora that
insurance companie use . You can request a4 certification that
you have in place . You don-t have to give them the policy. That
usually isn' t -done , I t-s gust a certification from the company
and give i t to the town . That's all we would need to support
that
Se l . Thomas: He ah returned to his vacation last night and
he'll probably be back in a week and at that time, he'll supply
us with everything for you to review.
Town ou'n el : But I 'm satisfied . . .Well , the point that I
making is that Vm satisfied that the contract that we have right
now which has been reviewed by his attorney and approved with the
addition of that addendum which address solely the issue of (ah)
the insurance thing, you know. ash It is appropriate to be the
operative contract for this project between Aubrey. and the Town.
e l . Lawrence: But you really didn' t totally answer my question.
Since the contract that we signed is not a legally binding
contract , because Dr . Aubrey hasn' t signed i t . . .
