09� Board. of Selectmen Page Two Regular Meeting Wednesday, March 25, 1987 Circle * Irs . Thomas and Mr. Lawrence detailed the actions that have been taken regarding Summerwood Condominiums and other areas affected and plans for the near and distant future . A "target date" of 1959 was indicated for the actual supplying of water by the Town to the affected areas . John Shea, Esc . was present for his clients Charles and Susan. Tuite of #14 Sum erwood. Mr. Shea stated that his clients are suffering an economic problem due entirely to the water, pollution problem and that 1989 is too far distant for them to wait for relief, Mrs . . Tuite reminded Mrs . Thomas that she had brought in the results of water testing at #14 Sump erwood taken by an independent , reputable agency, Mrs . Tuite stated that she had had no response , Mrs , Thomas stated that she had sent the test results report to various agency officials and had had no response . Mr. Shea. and r. McCarthy were given codes of the Phase I report and evaluation performed by Weston & Sampson. As this matter involves potential litigation, members o the Board of Selectmen unanimously agreed to decline any further dis- cussion of this smatter at this tame and without benefit of advice o Town Counsel. . This matter directly concerns $24,000.00. to fund the salary and expense account of the Conservation Officer. The matter was briefly discussed with further discussion con- tinued to the following geek at a. time to be mutually agreed upon, 5. Mr. Burtis re : blockage of access road. Mr., Burtis and his attorney, Mr. Rapo a, were present for this hearing as were Mrs . Richardson and her son, Robert, After inspection of the map showing Mr. Burtis ' deeded property and adjacent properties and after discussing the manner in which the DPT laid a, pavement which deprived Mr. Burns of access to Little River Boatyard, it was unanimously agreed by all those present that Mr. Burtis does indeed have the right to access and that the Director of the DPW will further, confer with Mr. Burns to make the necessary modification to the access- road. (This meeting proceeded out of order of the agenda as scheduled. NEW BUSINESS , 1. Shellfish Commission articles for Special Town Meeting.. The Shellfish Constable submitted two articles , l to transfer "00.00. from the reseeding account to the expense account to offset the purchase of a. new 25 horsepower outboard rotor. Mrs Ryan explained this request and the members unanimously agreed to include this article on the warrant for Special Town Meeting; 2 article' concerning docks reeds modifications which were explained to Mr, Ryan; however, it was unanimously agreed to include this article on the warrant for special town meeting in its modified state .
