ILISSClCTLLS[ttS.t}Town oj*-)1ashpee
gO'49
MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
JULY 11, 2018
The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, July 11,
2018, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road
North. Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Scott
Goldstein, and Associate Members, Brad Pittsley and Norman J. Gould, and Sharon
Sangeleer were present. Building Commissioner, Michael Mendoza was also present.
PLEDGE OF ALLEGIANCE
CONTINUED HEARINGS
34 Rainbow Lane: Petitioner, David Webb requests a Written Finding under §174-17 of
the Zoning Bylaws to allow for construction of an attached garage on property located in
an R-3 Zoning District, Map 69 Parcel 36F, Mashpee, MA. (Owner of Record: Faith A.
and Phillip Jackson). Continued from June 13, 2018 hearings at the request of the
applicant.
Associate Member, Sharon Sangeleer read the letter of withdrawal into the record from
David Webb, Petitioner dated Monday, July 9, 2018. Mr. Gould made a motion to accept
the withdrawal. Mr. Pittsley seconded. All were in favor.
9 Ockway Bay Road: Petitioner, William R. Haney requests an extension to an existing
Special Permit(SP-2012-30)under §174-25.I.9 of the Zoning Bylaws that was issued back
in July 2012, for a landing, stairs, pier, ramp and float on property located in an R-3 Zoning
District, Map 99 Parcel 49, Mashpee, MA. (Mary E. Zocchi, Trustee). Continued from
June 27, 2018 hearings at the request of the applicant
Attorney Brian Wall represented the application that was continued because the Board
wanted clarification from the Conservation Agent regarding the permit extension act. There
was also a condition that the dock could not be built without a house. The Board was
concerned about continuing or extending the permit without knowing the status of the
underlining wetlands permit. The Board said the normal process is that the applicant goes
to the Conservation Commission first, and then the applicant applies for a Special Permit
with the Zoning Board. The Board was concerned about extending the Special Permit with
the possibility that there was no wetlands permit in place. Mr. Wall said he contacted Mr.
McManus and pointed out that the permit was extended under the permit extension act
which he agreed and emailed the Board his revised cormnent.
Chairman Furbush read the email from Drew McManus into the record dated June 29,2018
stating the order of conditions for the dock is valid until July 10, 2019. Mr. Furbush also
read the email sent from the Harbormaster, dated June 27, 2018 stating he has no issues.
1
