S f ARD OF SELECTMEN Page MINUTES MON DAY 9 FEBRUARY 4j 1991 Popponesset Grid Selectman Carter asked if an indemnatty agreement is necessary from the users of the bridge. Town Counsel advises that ifthe bridge is taken by eminent domain it is not necessary unless the users of the bridge volunteered* It was noted a voluntary imdemnity agreement from the island residents would be: ;a problem. They have spent quite a bit of money for this concern. It was also noted that it will cost as much to litigate as to build the bridge. Kevin Harrington has indicated he is in favor of a resolution and an iridication from the property owners would be ben ficial. Town Counsel advises the association hold a question ire to be held before the proposed road layout since the Planning Board must hold a public hearing on this issue. This should be done before Town Meeting. Selectman Lawrence is in favor of the Board supporting an article for the eminent domain taking to start the process. to bring this to Town Meeting. He has made the motion stating this with the motion seconded by Selectman Hanson. Selectman Jacobson has reluctantly voted to accept the motion with her main concern being public safety. The vote is -o. Harbor Man ent Plan: Tom Fudala was present to discuss the Harbor Management Plan with the Board. Selectman Lawrence is concerned with one person being in charge of the plane He would like a group of individuals oversee the plan working as an advisory group. Such members would include the Executive Secretary, Town Planner, Harbormaster and Waterways Commission. Tom F"udala reports that it is not so much as one person in charge, but communicating with the state review process. Mfr. Harrington agrees the work should be done with Tom F data and there is actively a core group working committee consisting of the Harbormaster, Shellfish Constable, Health Agent Assistant, Ernie Virgilio with the DPWO Conservation Agent and Andrew Gottlieb serving as contact person for the Board who is also in touch with Falmouth, As long as the Executive Secretary is the key persons Selectman Lawrence has no problem. Mr. Darrington is appointed until '.the 28th of February. Selectman Lawrence would also like the core group informed of their position and if they wish to remain with the group. Selectman Carter has suggested Kevin Darrington and Tom F'udal review the members involved to see if they wish to remain as an advisory group and to review the size of the committee and core group, The motion was rade by Selectman Lawrence to reappoint Kevin Darrington to his position with the Harbor Mann ger ent Plan. The vote was seconded by Selectman Danson. The vote is favorable with the Board. ,,f,
