S <br /> f <br /> ARD OF SELECTMEN Page <br /> MINUTES <br /> MON DAY 9 FEBRUARY 4j 1991 <br /> Popponesset Grid <br /> Selectman Carter asked if an indemnatty agreement is necessary <br /> from the users of the bridge. Town Counsel advises that ifthe bridge <br /> is taken by eminent domain it is not necessary unless the users of <br /> the bridge volunteered* <br /> It was noted a voluntary imdemnity agreement from the island <br /> residents would be: ;a problem. They have spent quite a bit of money <br /> for this concern. It was also noted that it will cost as much to <br /> litigate as to build the bridge. <br /> Kevin Harrington has indicated he is in favor of a resolution <br /> and an iridication from the property owners would be ben ficial. <br /> Town Counsel advises the association hold a question ire to be <br /> held before the proposed road layout since the Planning Board must <br /> hold a public hearing on this issue. This should be done before <br /> Town Meeting. <br /> Selectman Lawrence is in favor of the Board supporting an article <br /> for the eminent domain taking to start the process. to bring this to <br /> Town Meeting. He has made the motion stating this with the motion <br /> seconded by Selectman Hanson. <br /> Selectman Jacobson has reluctantly voted to accept the motion <br /> with her main concern being public safety. The vote is -o. <br /> Harbor Man ent Plan: <br /> Tom Fudala was present to discuss the Harbor Management Plan <br /> with the Board. <br /> Selectman Lawrence is concerned with one person being in charge <br /> of the plane He would like a group of individuals oversee the plan <br /> working as an advisory group. Such members would include the Executive <br /> Secretary, Town Planner, Harbormaster and Waterways Commission. <br /> Tom F"udala reports that it is not so much as one person in charge, <br /> but communicating with the state review process. <br /> Mfr. Harrington agrees the work should be done with Tom F data and <br /> there is actively a core group working committee consisting of the <br /> Harbormaster, Shellfish Constable, Health Agent Assistant, Ernie Virgilio <br /> with the DPWO Conservation Agent and Andrew Gottlieb serving as <br /> contact person for the Board who is also in touch with Falmouth, <br /> As long as the Executive Secretary is the key persons Selectman <br /> Lawrence has no problem. Mr. Darrington is appointed until '.the 28th <br /> of February. Selectman Lawrence would also like the core group informed <br /> of their position and if they wish to remain with the group. <br /> Selectman Carter has suggested Kevin Darrington and Tom F'udal review <br /> the members involved to see if they wish to remain as an advisory <br /> group and to review the size of the committee and core group, <br /> The motion was rade by Selectman Lawrence to reappoint Kevin <br /> Darrington to his position with the Harbor Mann ger ent Plan. The vote <br /> was seconded by Selectman Danson. The vote is favorable with the Board. <br /> ,,f, <br />
