Selectman Jacob- <br /> son agrees and hopes the Town is in the position to allocate the funds. <br /> The -money should be set aside with the identification of the <br /> needs states Selectman Danson, Addirg the $57, 000 to the identified <br /> surplus of $368P550, the money to be returned amounts t $425, 550. <br /> Town Counsel has advised it would be f'avora'ble if the Board and <br /> Finance Committee could agree with the School Committee to avoid <br /> Possible litigation against the Town. <br /> If we go to court, we would probably prevail states Counsel. <br /> In January of 1991, the School Committee sought to do this, By - law, <br /> tuition cannot be paid more than three months in advance and not into <br /> another fiscal year. The School Department did not budget for pre- <br /> payment. In the opinion of the Department of Revenue, this cannot <br /> e done. <br /> The Board is in agreement to remain firm with the reduction o <br /> $150o000o Selectman Lawrence noted he voted against the $150, 000. <br /> If the balance of the FY 91 budget is more, he would look to reduce <br /> the amount Further$ <br /> It is the Board' s position to remain with the reduction of $150, 0008 <br />' <br /> if it is not in agreement with the three boards, Selectman Carter will <br /> explain this at Town Meeting, <br /> 6:42 p.m. Jim Vaccaro has arrived for the Meeting. <br /> 6:43 p.m. The School. Committee Members and Dr. DeMoura have arrived <br /> for discussion. <br /> Selectman Carter informed the School Committee and Dr. DeMoura. <br /> the Board of Selectmen voted on April 30, 1991 to recommend a. further <br /> reduction of their budget in FY 92 t $150, 000. The Board of Selectmen <br /> have remained firm in this reduction. The Finance Committee has <br /> recommended a reduction o $100, 000 From the School Department' s budget. <br /> Chairman Conery on behalf of the School Committee will remain <br /> firm with the budget in the Warrant of $5, 050, 000. <br /> Chainnan Carter has informed the School Committee and Dr. DeMoura <br /> based on the recommendations of Town Counsel., it' s illegal for pre- <br /> payment of tuition.
