1 <br /> BOARD OF SELECTMEN Page 10 <br /> MINUTES <br /> MONDAY , AUGUST 5, 1991 <br /> National Guard Bureau - Briarwood: <br /> Selectman Gottlieb agrees that this is as good as we are going <br /> to get in terms of the agreement. He recommends to execute as quickly <br /> as possible with the language inserted. <br /> Selectman Lawrence is in agreement as long as the Town of Mashpee <br /> is not liable. <br /> The motion was made bybSelectman Jacobson to move that the <br /> Board of Selectmen withdraw from negotiating and/or approving a <br /> settlement with the National Guard Bureau to effect remediation for <br /> well water contamination in the East and West Briarwood sections <br /> and Otis Trailer Park, an area as more particularly defined in Appendix <br /> 1 of the proposed Memorandum of Agreement, and that sole authority <br /> for reaching settlement be given to the Board of 'eater Commissioners <br /> of the Mashpee Water District and further, that upon the request of <br /> the said Commissioners, the Board of Selectmen endorse said settlement <br /> insofar as it is able to do so without binding the Town of Yiashpee to <br /> undertake any obligations imposed by said settlement and further that <br /> the Board of Selectmen, upon request of said Commissioners, waive any <br /> claim of the Town of Mashpee for remediation for said well water con- <br /> tamination which is the subject matter of the current on going neg- <br /> otiation by the National Guard Bureau and the Mashpee Water District <br /> as more particularly appears intthe memorandum of Agreement which has <br /> been accepted by the District Water Commissioners. <br /> The motion was seconded by Selectman Gottlieb. The vote of <br /> • the Board is unanimous. The vote is 4-0. <br /> The time frame for the agreement is before the lst of October. <br /> Some residents were concerned with the roads of Tri Town Circle <br /> and Horseshoe Bend way to be reimbursed by the Town with the allocation <br /> of money recieved. <br /> Selectman Gottlieb informed them that every attempt has been <br /> made to represent you, but there has been no progress made. Judy <br /> Mills added that all of the wells tested came clean and the Govern- <br /> ment flatly refused to pay for the roads in question. <br /> The money is to be spent by the Water District in the areas <br /> marked for East and West Briarwood or the money will be in violation <br /> of code informed Selectman Gottlieb. <br /> 9.52 p.m. NEW BUSINESS : <br /> Optional September ballot question: <br /> Mr. Harrington informs the Board this is a one time option to <br /> vote on the effects of 22. He has recommended not to persue the super <br /> Tuesday option. <br /> Mr. Harrington will provide an overview to the Board of the <br /> deficit problem on the Meeting of August 19, 1991. <br /> Letter of Resignation from Carla Meskill from the Arts Lottery <br /> Council: <br /> The motion was made by Selectman Jacobson to approve the resigna- <br /> tion of Carla Meskill from the Mashpee Arts Lottery Council. <br /> The motion was seconded bybSelectman Caffyn. The vote of the <br /> Board is unanimous. <br />
