1
n. ` BOARD OF SELECTMEN Page 23
Y
MINUTES
MONDAYt SEPTEMBER 9t 1991
ointment to the Cape Cad -Commission:
She could - stayed for that motion states Selectman Caffyn.
I can' t answer that question other than to suggest to you that 1
think Mrs. Jacobson did the proper thing. Not withstanding the fact
that it ultimately hurt her, I think that was the correct ethical thing
to do states Counsel. Because she is one of the candidates for the
position. It was a. gracious thing for her to do.
But we are not talking- about the time, -we are asking for the
vote to simply put it on as an issue states Selectman Caffyn, I
cannot understand why she cannot be present .to whether she wants
to go ahead. . I think it' s the premise that we should even be deciding
this. I think that she could of participated,,
I'm not really sure what you are talking about. . .Well I will try
to rephrase itbecause' I am pr o1 ably not doing a very goodjo ,
The First voe was that we would have it as an agenda item states
Selectman C a fflyn. Yes replys Counsel.. Just have it as an agenda
item. Yes. I- feel she should not have been exempted just to have it
as an agenda, item. That show' s -no prejudice one way or another towards-
whether its her or not, but its just an agenda iter,
She voluntarily stepped down and I think that was appropriate
for her to do and -I probably would have dome if I were in ler circum-
st noes states Counsel. Had she voted on it, she would be accused
of being in potentially in conflict or trying to further or advance her
own. . 1 think what she did was a very appropriate thing.
I have a. question for Mr. Reardon please states Mrs,. reeli sh.
When the previous discussion was going on, in which I guess there was
a. big case one way or the other about you a conflict. The moment cane
-for you to second a motion and you asked .lir. Reardon if that would be
a. problem 'if you seconded a. motion (referring to lir. Manson) to re-
negotiate the situation. And you said no. leo it woldn' t ' e states
Counsel. Why not?
He is not a. candidate for the office. But the motion is on whether
or not there will be a. discussion of the candidate states Mrs, Greelish,
Just like there was a motion to negotiate with lir# Hanson . 9 . Two
entirely separate and distinct legal points, absolutely distinct states
Counsel.. The issue that is before the Board night now is.
As 1 understand lir. Lawrence' s vote was to see if the Board will
proceed to vote to fill the vacancy on the Cape Cod Commission as a.
agenda. item. Mrs. Jacobson is a candidate for the office. I under-
stand that states Mrs. Greelish,
I would like to go on record, ray name is Deidre reelish. . * I hear
you, I am not aware that anybody asked me for a. ruling with reference
to Mr. Hanson. Particularly on an issue. . . . Yes, but he did not state
that he was going to conduct the negotiations. He specifically stated
that he would not make that decision until after the discussion. That
was a. very saving point states Counsel.
Two members of a, five-I.member board of selectmen are about to vote,
three members states Mrs, Greelish, rather than five are about to vote
on the person who is going to represent Mashpee to the Cape Cod Commission
and you are lacking a member for religious reasons. The roan is away
for religious reasons and I really hope you will reconsider and take
your chances with a. full boa.rd,,
