5 ' BD OF SELECTMEN Page MINUTES JANUARY 1 .L._1332 MONDAY, Donna ' s Lane : Town Counsel advised that the appraiser hired by the Town in- dicated there would be no additional Compensation since we were en- hancing the value of their property by putting a road, there . If the Town doesn ' t do anything with the road, will it create some damage to the property owners by taking the road and not en- hancing their property asks Mr. Baker - ,As the appraiser indicated reports Counsel , there would be no diminution in value to the land abutting the three parties . The Creation of a public way would add to the value of their land. The emninent domain power was taken for a specific reason and the Town is obliged to carry this through. The money Care from the DPT expense account which was voted for by Town Meeting for DPW expenses informs Selectman Vaccaro. There is..Ano justification for the, ._money to be encumbered since there i no contract for it . . He suggests to return the money to the TownAccount- and to be returned to the general fund. *The motion was made by selectman Vro ,t ; direst .t.he' Town Accountant to return the sun of $11 , 582 to the general fund to be rade avd i fable for free Cash next year, The motion was seconded by Selectman Caffyn. The vote of the Board is unanimous . The vote is - . Mr. Taylor suggests to have a Meeting with the abutters before the final action. The Board is in agreement -and suggests the Town Planner be present. Selectman Jacobson directed Mr.s. Mason to schedule a meeting for February 17 , 1332 for the purpose of this discussion. With a lana taking, selectman Caffyn asks Counsel if signature of agreement are required by the land abutters? Town Counsel replys no. Town Meeting authorized the Selectmen to layout a public way. Selectmen are in support of the ongoing investigation of the local and state police efforts . The motion was seconded by Selectman- Mills . The vote of is unanimous . The vote is 4-0. Selectman Jacobson directed Mrs, Mason to send a letter out as soon as possible.
