BOARD OF SELECTMEN Page 2 <br /> MINUTES <br /> • MONDAY, APRIL 27, 1992 <br /> PUBLIC DISCUSSION: <br /> Richard Halpern made the suggestion to give the same <br /> courtesy to the Water District Meetings as the Town and not <br /> schedule meetings when it is their annual or election district <br /> meetings . <br /> Selectman Jacobson recommends to notify the Selectmen <br /> through the Executive Secretary. All departments and committee ' s <br /> can then be notified . <br /> 7 : 11 p.m. The Meeting has temporarily adjourned to move <br /> into the Great Room. <br /> 7 : 18 p.m. Meeting re-convened . <br /> Popponesset Corp. ' Entertainment License Hearing: <br /> Many residents including Mark Gildea , William Zammer and <br /> Barry Alderissi were present to voice their opinions on the <br /> entertainment from the Popponesset Inn and Marketplace Cafe and <br /> Raw Bar . <br /> Mr. Harrington relates that there have been a number of <br /> complaints due to excess of noise from the above establishments . <br /> All of the residents with complaint were notified of the Public <br /> Hearing. <br /> • Mr. Gildea indicates there has been no violation this year . <br /> Our track record has been good and we have been given no <br /> opportunity to hear of or receive the noise complaints . <br /> Town Counselrelates that the Public Hearing scheduled for <br /> tonight is in reference to the Entertainment License and not the <br /> issue of noise . He suggests to solicit public comment to address <br /> this issue. He indicates the seasonal license for the above <br /> establishments have been granted . <br /> Selectman Caffyn recommends to have an annual review of each <br /> license . Town Counsel relates that this is not a standard <br /> practice ofthe Selectmen . The annual renewal consists of <br /> reports received from various inspectors. This includes the <br /> compliance with building codes , fire safety, proper sanitary <br /> precautions and health requirements that are renewed on an annual <br /> basis . Town Counsel also indicates that there are no legal <br /> requirements to hold hearings on complaints . <br /> Mr. Zammer feels the excess noise factor was due to the <br /> hurricane that occurred last August . There isrockn <br /> adjacent to the perimeter of the property. Wi`t'h`trhe"loss of <br /> leaves , noise has traveled without the buffer zone. Trees are <br /> now starting to foliate . He does not perceive this as a problem <br /> and indicates he has not received notification of complaints . <br /> All attempts will be made to minimize the noise indicates Mr. <br /> Zammer. We don ' t run the type of operation for loud noise. He relates <br /> if the wind is blowing in the right direction, you will hear the noise <br /> from the bands performing. His bands do perform outdoors . <br /> • <br />
