BOARD OF SELECTMEN Page 3 <br /> MINUTES <br /> • MONDAY, APRIL 27, 1992 <br /> Popponesset Corp. Entertainment License Hearing: <br /> Mr. Zammer indicated that he will attempt to keep the noise <br /> at a medium. He notes that he doesn ' t run the type of operation <br /> for loud noise . <br /> Colin Fitzgerald voiced his concern to the loud noise and the <br /> disturbance to his family. He suggests to turn the volume down . <br /> In representation of the Marketplace , Barry Alderissi <br /> indicated that there is outside entertainment four nights per <br /> week from Memorial Day to Labor Day from 6 : 30 p.m. to 9 : 00 p.m: <br /> Most of the noise is contained within the area that is surrounded <br /> by buildings. <br /> Richard Parsons in representation of the Rock Landing <br /> Associates has asked for a copy of the minutes of the- public <br /> hearing and the notice of the public hearing. <br /> Selectman Jacobson read his letter dated October 10, 1991 <br /> into the minutes as a public record of the proceedings. Concerns <br /> of the residents include patrons milling and drinking alcoholic <br /> beverages in the parking lot after 1 : 00 a .m. , patrons singing and <br /> dancing well after 1 : 00 a .m. , plastic glasses found on the beach <br /> and the excessive noise generated from the Inn. <br /> The Rock Landing Association has recommended the Board draft <br /> a bylaw for Environmental Performance Standard-Noise and <br /> vibration Control . They request the police monitor for compliance <br /> • of the provisions of Chapter 138 and to place the Board in <br /> immediate receipt of license violations . <br /> Mr. Gildea in defense of the Inn indicated that there are no <br /> complaints on record of patrons present and drinking in the <br /> establishmenth�,?, In the lower deck area there is a beach fence to <br /> protect the beach grass so it may not be the patrons from the Inn <br /> and that sound carries . The hurricane may very well of been a <br /> contributing factor. <br /> Selectman Jacobson notes that all letters of complaint have <br /> been copied to the Police Department. <br /> James R. Collins , President of Rock Landing indicated that a <br /> representative went to the Selectmen ' s office last August and was <br /> told we would be advised of the hearing in reference to the <br /> liquor license. A letter was also sent to Chief Frye asking him <br /> to bring the complaints to the public hearing. He said he would <br /> represent the complaints logged to the Police Department or have <br /> the information present as to the number of calls made to the <br /> Police Department . <br /> Elizabeth Petti spoke in favor of the Inn as a quiet family <br /> place and notes the parking lot is monitored with attendants . <br /> She relates the problem is with the Marketplace and uncontrolled <br /> activities . <br /> Beverage Manager of the Inn, Brian Hyde indicated that there <br /> is never alcoholic beverages in the lounge after 1 : 00 a .m. All <br /> patrons are out the door by 1 : 10 a .m. and they do not use plastic <br /> • cups at the Inn. <br /> i <br />
