Entertainment License Hearing: <br /> It was noted that the Cabana Club located next door to the <br /> Inn is open for private groups . There is a " general rule where no <br /> one is to leave the premises with a plastic cup. <br /> Mr. Fitzgerald related that he has no complaints with the <br /> operation of the Inn, but to the noise factor. <br /> It is a matter of prudence for every liquor license to be <br /> reviewed annually and be part of the public record indicates <br /> Mr. Parsons . He relates that there is no Town bylaw with <br /> reference to an environmental standard with respect to noise <br /> pollution. <br /> Carole Dunivan spoke in favor of the establishments and <br /> related that this is a resort area . If you don ' t like the music, <br /> you shouldn ' t be there ! <br /> S. J. Chen noted that he has called the Police Department of <br /> the noise factor. He was told that they have an entertainment <br /> license and therefore nothing can be done. He requests the <br /> volume be turned down after 10 :00 p.m. The music doesn ' t have to <br /> be that loud. <br /> Mr. Chen also relates that he was not notified of the <br /> license renewal and asks who he can call with a complaint if the <br /> Police Department doesn ' t respond? He suggests the area <br /> residents and establishments work together. <br /> Mr. Parsons notes there are 35 homeowners that abut the <br /> • Popponesset Inn and a majority have lived there for over twenty <br /> years. It is customary for rock groups to play. In the past it <br /> was entertaining. He indicates a series of events during August <br /> before the hurricane of where the Marketplace and Inn combined <br /> reached a level to seek action to modulate the music. <br /> There was no action taken by the New Seabury Corporation or <br /> the Police Department . indicates Mr. Parsons . He suggests action <br /> to be taken to insure all future licenses specify a reasonable <br /> decibel level and limit the number of groups under the license <br /> issued and stipulate the hours. <br /> Direction should also be provided to the Police Department <br /> to address complaints to ensure there is no open consumption of <br /> alcoholic beverages relates Mr. Parsons . <br /> There were seventeen people who stood in support of the <br /> license holders. <br /> Town Counsel suggests the Board should decide if there is <br /> sufficient cause existing to hold a public hearing for <br /> consideration of imposing restrictions on the hours of <br /> entertainment and amplification of music live or recorded from <br /> the two facilities . <br /> The Board of Selectmen have the inherent power to impose <br /> reasonable restrictions as to the use of the license , hours of <br /> entertainment and decimal of music relates Counsel . <br /> • <br /> III <br />
