BOARD OF SELECTMEN Page 12 <br /> MINUTES <br /> MONDAY, APRIL 27, 1992 <br /> Request of Richard Martini : <br /> - *It is the agreement of the Board to send a letter to <br /> Mr. Martini requesting he be more specific to his request of all <br /> of the Executive Session minutes from September of 1991 to the <br /> present date. The Board could then isolate the general subject <br /> matter of request . <br /> Selectman Caffyn asks if the cost can be absorbed by the <br /> .person requesting copies since Town Counsel would be required to <br /> review the past minutes. <br /> Town Counsel indicates that there is a statutory fee <br /> structure of what attorney 's can charge. <br /> REview of Executive Session Minutes : <br /> *It is the consensus of the Board to begin the process to <br /> review the Executive Session minutes . Town Counsel will review <br /> the litigation aspects and Collective Bargaining. <br /> With the regards to the request for minutes the Board was <br /> advised by Counsel that any government agency that receives a <br /> request must respond to the party within ten days in furnishing <br /> the requested documents. <br /> With concerns to the Open Meeting Law, Counsel advises if <br /> one public body holds a meeting and another pubic body attends <br /> the meeting in quorum and participates , the meeting should be <br /> posted. <br /> Mr. Harrington recommends the Board post the meetings they <br /> are planning on attending. <br /> In terms of Shellfish enforcement being discussed in <br /> Executive Session on April 21 , 1992 , the Board agreed that this <br /> was always an Executive Session item of discussion. It was <br /> brought up because it needs to be discussed on a future agenda . <br /> Selectman Jacobson did indicate that it was out of order to <br /> discuss this subject . <br /> A meeting is scheduled for May 18 , 1992 in Executive <br /> Session. Town Counsel will give the Board strategy to this <br /> concern. <br /> Selectman Caffyn noted that Mr . Harrington should have given <br /> the Board advisement of the Open Meeting Law and the rules of the <br /> Open Meeting Law. <br /> Adjournment • <br /> ****The motion was made by Selectman Caffyn to adjourn the <br /> meeting at 11 : 20 p.m. The Board will enter into Executive <br /> Session to discuss Collective Bargaining relative to the Fire <br /> Department and Complaints against an employee. The motion was <br /> seconded by Selectman Mills. VOTE: Unanimous . 4-0. <br /> Roll Call Vote : Unanimous. 4-0 .
