BOARD OF SELECTMEN Page 5 <br /> MINUTES <br /> MONDAY, MAY 11 , 1992 <br /> Donna ' s Lane: <br /> Mr. Talanian plans on moving the mini golf and requests to <br /> maintain his license on an interim basis until he can relocate <br /> the establishment . His license is to expire on August 3 , 1992 <br /> and is currently in appeal. <br /> Selectman Jacobson gave a brief synopsis of initial <br /> discussions relative to Donna ' s Lane. Consideration in the most <br /> recent analysis was involvement of the Town in signalization. <br /> Field ' s point and Mr. Talanian would then be required to each <br /> contribute 50% towards the improvement to the road . <br /> Mr. Chase responded that he did not understand the <br /> obligation to move ahead on Donna ' s Lane. He related that there <br /> is no immediate or idle cash with no defined commitment. There <br /> is no logic to be responsible for 50% of the road . He indicated <br /> that damages have not been asked for with the taking of the road . <br /> Doug Storrs suggests they return with a list of conditions <br /> in return for the betterment assessment . <br /> Selectman Costa suggests to review the special permit <br /> granted to improve the entrance and maintain the conditions of <br /> the special permit . <br /> Mr. Storrs indicates under the special permit, Donna ' s Lane <br /> is to be formed into a driveway and not to roadway standards. <br /> *Selectman Caffyn recommends for Field ' s Point to place their <br /> considerations in writing to the Board as to what is requested <br /> from the Town and how they wish to participate . She relates that <br /> the Board has no control over the Zoning Board of Appeals . <br /> Mr. Segal indicates that if the ZBA conditions are not <br /> changed, they do not wish to participate and be involved in two <br /> years of negotiating. <br /> Mr. Storrs requests that all four parties become involved in <br /> negotiations . He questions the Town ' s commitment to <br /> signalization . <br /> Selectman Mills indicates that if it is deemed necessary, it <br /> will be the Town ' s responsibility. If the property is developed , <br /> the impact would fall on Fields ' Point. <br /> Mr. Taylor determined the betterment cost over a twenty year <br /> period to be $4,000 per year for the two parties . This does not <br /> include the interest of which the current rate is 7%. <br /> Mr. Taylor will return with the actual specifications , cost <br /> and definition of the road . <br /> Mr. Baker made the suggestion to return the road back to the <br /> original owner. He relates the commitment that no Town funds <br /> would be spent on Donna ' s Lane without voter approval at Town <br /> Meeting. <br /> Mrs . Greelish agrees to give the road back and start over <br /> with honest negotiations in an honest and open vote. <br /> Town Counsel indicates that Town Meeting can vote to abandon <br /> Donna ' s Lane. He will review the ramifications . <br /> *Mr. Storrs will submit a list of considerations towards an agree- <br /> ment and schedule for an appointment with the Board. <br />
