t , <br /> 4 <br /> BOARD of SELECTMEN Page <br /> MINUTES-SPECIAL MEETING <br /> TIA F DAY r AUGUST 20, 1992 <br /> Attorney Avery indicates that Attorney Monahan rade a <br /> financial settlement offer . This was discussed with the <br /> Hendricks family and determined to be sufficient to provide <br /> financial security for the son informs Attorney Avery. The case <br /> { was then settled . <br /> Attorney Avery indicates that this particular case was so <br /> volatile with strong emotions , Judge Watson asked to see the <br /> parties separately in his chambers. <br /> The Hendrick family indicated that they were satisfied with <br /> the financial settlement informs Attorney Avery. Mrs . Francis <br /> Hendricks mace note of her concern that Sergeant Mace remains <br /> active as a Police Officer in Mashpee, she asps the Judge if he <br /> is going to leave the Town. <br /> Attorney Avery indicates that this request was not part of <br /> the settlement . Attorney Monahan made note that plans were being <br /> made by sergeant Mace and it was his intention to leave Mashpee. <br /> The Hendricks family does not think that the issue of what <br /> was in the settlement is the issue before the Town informs <br /> Attorney Avery. The issue i , should Sergeant Mace be employed <br /> y the Town? <br /> Attorney Avery indicates that much of the evidence was <br /> ignored by the Nudge. This includes the many photographs and <br /> video tapes of the incident. <br /> Evidence shows that David Hendricks was . shot and killed <br /> though his automobile in a second round of shots informs Attorney <br /> Avery. He was shot from the side in very close range . This <br /> evidence should be considered by the Town relates Attorney Avery. <br /> Attorney Avery indicates that he has written to selectman <br /> affyn requesting she order the transcripts and reopen the <br /> issue . Is sergeant Mace a safe person to be on the Police force? <br /> The question was asked if the Town participated in the <br /> settlement . Attorney Morse indicates the Town was not involved <br /> in the settlement. She noted that the newspaper indicated the <br /> Town was involved in the settlement . <br /> The Town of Mahpee chid not participate in the settlement <br /> informs Attorney Morse . The insurance company settled the case . <br /> The selectmen were not aware of the settlement until their <br /> meeting of August 17, 1992 . <br />
