t , 4 BOARD of SELECTMEN Page MINUTES-SPECIAL MEETING TIA F DAY r AUGUST 20, 1992 Attorney Avery indicates that Attorney Monahan rade a financial settlement offer . This was discussed with the Hendricks family and determined to be sufficient to provide financial security for the son informs Attorney Avery. The case { was then settled . Attorney Avery indicates that this particular case was so volatile with strong emotions , Judge Watson asked to see the parties separately in his chambers. The Hendrick family indicated that they were satisfied with the financial settlement informs Attorney Avery. Mrs . Francis Hendricks mace note of her concern that Sergeant Mace remains active as a Police Officer in Mashpee, she asps the Judge if he is going to leave the Town. Attorney Avery indicates that this request was not part of the settlement . Attorney Monahan made note that plans were being made by sergeant Mace and it was his intention to leave Mashpee. The Hendricks family does not think that the issue of what was in the settlement is the issue before the Town informs Attorney Avery. The issue i , should Sergeant Mace be employed y the Town? Attorney Avery indicates that much of the evidence was ignored by the Nudge. This includes the many photographs and video tapes of the incident. Evidence shows that David Hendricks was . shot and killed though his automobile in a second round of shots informs Attorney Avery. He was shot from the side in very close range . This evidence should be considered by the Town relates Attorney Avery. Attorney Avery indicates that he has written to selectman affyn requesting she order the transcripts and reopen the issue . Is sergeant Mace a safe person to be on the Police force? The question was asked if the Town participated in the settlement . Attorney Morse indicates the Town was not involved in the settlement. She noted that the newspaper indicated the Town was involved in the settlement . The Town of Mahpee chid not participate in the settlement informs Attorney Morse . The insurance company settled the case . The selectmen were not aware of the settlement until their meeting of August 17, 1992 .
