BOARD OF SELECTMEN Page 2
MINUTES-SPECIAL MEETING
• THURSDAY, AUGUST 20, 1992
AMENDMENTS AND CLARIFICATION TO SPECIAL MEETING:
Page two, seventh paragraph: Attorney Avery: The civil
case became the focus for the investigation of this matter on the
part of the Hendricks family. To understand the settlement in
the civil case, I think you have to understand that the civil
case as a legal matter had a very, very narrow purpose states
Attorney Avery.
Mr. Hendricks was survived by his son, Stacy Dana Peters
states Attorney Avery. The purpose of that civil case was, the
legal purpose of that civil case was to try to get compensation
for David Hendrick 's death for Stacy Dana Peters. So that this
young boy who at the age of eight years old had his father taken
from him would have a solid and secure financial basis to get
through his life once he became an adult . That was the sole
legal remedy available in that case . The only thing the court
system could do in that case would be to ask and answer the
question, Was Stacy Dana Peters entitled to compensation?
In order to get to that point however, we had to try and get
to the truth of what happened the day that Hendricks and the
truth about what Sergeant Mace had done and that became the focus
of our efforts explains Attorney Avery.
Seventh paragraph: Delete the word " in" and insert the word
"a" in the second sentence to read : The purpose was to secure
Mr. Hendricks son, Stacy Dana Peters a financial compensation.
Page two, paragraph eight : Attorney Avery: After the long
process , which Mr. Randall alluded to of taking depositions and
gathering evidence, and interviewing witnesses and gathering
documents and gathering photographs there were as many as a
hundred photographs that were taken by the State Police and the
Bureau of Criminal Investigation informs Attorney Avery.
Video tapes and talking to over a dozen people who had
witnessed the event, taking much of their testimony under oath,
we finally were ready to begin trial and did begin trial on June
22 , 1992 informs Attorney Avery.
Page two, eight paragraph: Include after the word taken; by the
State Police and Bura,au ,of Criminal Investigation. To read: Many
photographs and video tapes were taken by the State Pollee and
Bureau of Criminal Investigation notes Attorney Avery.
Page three, third paragraph: Last sentence - typo - insert the
word"asked0to read: She asked the Judge if he is going to leave
the Town.
•
