BOARD OF SELECTMEN <br /> MINUTES-SPECIAL MEETING <br /> • THURSDAY, AUGUST 20, 1992 <br /> AMENDMENTS AND CLARIFICATION TO SPECIAL MEETING: <br /> Page two; first paragraph: To include the word "no" as it <br /> appears to read no insufficient allegations - statement was made <br /> by Attorney Randall . Delete the word defender as the last word <br /> in the paragraph and insert the word defendant as stated by <br /> Attorney Randall . <br /> Page two, fourth paragraph: Clarification to second <br /> sentence; Attorney Randall indicates that Sergeant Mace was found <br /> not guilty of any wrongdoing. Statement from Attorney Randall : <br /> There was determination by the Judge who heard the case that <br /> there was no criminal activity involved in the death nor was <br /> Sergeant Mace guilty of any negligence or wrongdoing. <br /> Page two, fifth paragraph; clarification of what Attorney <br /> Avery actually said: In presentation, Attorney Avery indicated <br /> he represented the estate of David Hendricks and the lawsuit that <br /> was just described . This was settled this year on June 29 , 1992 <br /> before Judge Watson in Federal Court . To understand the <br /> settlement and what it means , we have to put it into a little <br /> perspective in terms of what that lawsuit was about and how it <br /> came to be settled . <br /> • Page two, Sixth paragraph: Mr. Lawrence Hendricks, his son <br /> Michael and son in-law Nelson Andrews came to see me states <br /> Attorney Avery. After the inquest, a couple of years after the <br /> inquest they asked me to get involved in this case. I 'm a Civil <br /> Rights lawyer and have been a Civil Rights lawyer for twenty-two <br /> years . I 've done many cases like this and they asked me to get <br /> involved in this case . I told them I don ' t like to get involved <br /> in cases that are two years old . Before I get involved I want to <br /> review what has happened in the case so far states Attorney <br /> Avery. <br /> They presented me with the transcript of the inquest states <br /> Attorney Avery and with Judge Ryan ' s findings . After studying <br /> the transcript of that inquest and particularly after studying <br /> Judge Ryan ' s findings , it was my opinion that a very, very <br /> serious and grave injustice had taken place at that inquest <br /> states Attorney Avery. <br /> I very willingly and was honored to get involved in the case <br /> to try to do something about it states Attorney Avery. <br /> Page two, sixth paragraph: Delete the words "he then <br /> learned that" and insert the words "in his opinion" To read : <br /> Attorney Avery indicates in his opinion, there was a serious and <br /> grave injustice that had taken place at the inquest . <br />
