BOARD OF SELECTMEN <br />MINUTES <br />M NDAy, MARCH 1 , 1993 <br />Seasonal Liquor License Discussion: <br />Wage 2 <br />Mr. Whritnour indicated that there is no requirement as t <br />the number of hours a manager must be on the premises of a liquor <br />license establishment. <br />Attorney Marder indicated that the set number of hours can <br />be placed in the form of a policy as defined by the Board of <br />Selectmen,. <br />The owner of a liquor license establishment must designate <br />the name of a manager to the Board of Selectmen, Police <br />Department and Building Inspector informed Attorney Marder. The <br />owner will -be subject to disciplinary action if the manager is <br />changed without the Board of Selectmen's approval. <br />A separate public hearing is necessary to change managers <br />informed Attorney Larder. This requires a separate application <br />form from the ABCC that specifically addresses the issue of <br />managers. <br />If a business has a lot of activity such as an outdoor <br />lounge, beach club and cabana, all the activities are to be <br />described on the license and approved by the Board of Selectmen <br />informed Attorney Marder.. The Board of Selectmen would recognize <br />the establishment as one entity with one Manager. <br />Two separate and distinct businesses on the sa►e property <br />would require -separate licenses noted Attorney Marder, Liquor <br />can only be sold at the specific site designated as on the <br />license. <br />Attorney Mark Gildea was present on behalf of the Popponeset <br />Corporation* He noted that the seasonal liquor license renewal <br />is to begin on April 1, 1993. He has requested the Board of <br />Selectmen approve the renewal, There is no action at this time. <br />As per the Town bylaw, there is no entitlement for renewal <br />if taxes have not been paid informed Attorney Marder, , The <br />license can be denied for failure to pay taxes. The non-payment <br />of taxes are posted and listed by the Town. <br />If a license has been approved by the Board of Selectmen and <br />also by the ABCC, the Department of Revenue can disapprove the <br />license application if there are unpaid taxes on the State level <br />informed Attorney Marder. <br />2 . p.r .
