Kanter Bk. #30546 <br /> 6 Kanter Lane Pg. 4199 <br /> (Map 119 Parcel 1B) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 8, 2017 by Owner, Martha J. Kanter requesting <br /> a Modification under §174-74 of the Zoning Bylaws to extend a pre-existing non- <br /> conforming setback by.l" and increase the footprint of the home by adding a 4' x 10' <br /> covered front stoop, and extending a room in the back of the house by 4' x 12' with an <br /> attached 6' x 12' deck on property located in an R-3 Zoning District, at 6 Kanter Lane, <br /> (Map 119 Parcel 1 B), Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on December 15, 2017 and December 22, <br /> 2017 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 2018 at which time the following members of the Board of <br /> Appeals were present;.Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> and Associate Members, Norman J. Gould and Sharon Sangeleer. Also present was <br /> Building Commissioner, Michael Mendoza. <br /> Attorney Brian Garner represented the applicant for the Variance Modification. He <br /> provided the Board with his written narrative and mentioned that the property was granted <br /> a Variance back in 1995 which allowed for the elevated second story that is depicted on <br /> the 3-D house plan. The space will be enclosed under the elevated second story room, and <br /> an attached deck. The Variance was granted initially for the front yard setback, which in <br /> 1995 would have been 30 ft. The Board had granted a Variance to allow the existing front <br /> setback to decrease to 12.2 ft. This proposed alteration to the existing structure will further <br /> encroach on the front yard setback by one tenth of a foot. Since this will take up additional <br /> footprint, he thought it would be appropriate to apply to the Board, and seek relief and <br /> considers this addition de minimis. <br /> 1 <br />
