Pare School -- Tome: Stewart Director_ December 11, 1974 <br /> The Board of Selectmen questioned::T.om°:-abbut_:the present status <br /> of Dare School. When it was first founded, it was for residents , <br /> and educational programs were preformed on grounds. This no <br /> longer applies. - Students are now temporarily living in Mashpee <br /> and are not residents. The education required, will mean trans- <br /> portation and educational cost to the Town of Mashpee. <br /> The case of Larry Gomes was mentioned. He does not have any living <br /> parents ; but does have some relatives in Falmouth. Tom firmly <br /> believes his guardian to be the Division_ of Family Services. <br /> Kevin points out, if this is so, let them pay for the education. <br /> Mashpee is' unique, they must pay for the busing of their students <br /> to other schools and the educational cost of each student. <br /> Tout: 1 think- you are saying, Mashpee would be reawnsible for the <br /> educational cost for every student at Dare. The law clearly states, <br /> "The town where the parent of the child lives is responsible for the <br /> cost of the education of that child. " <br /> Selectman Hicks inquired, "What would happen if they refuse to pay?" <br /> Tom: If they refuse to pay, I would refer to your town. counsel. <br /> I don't think the bill would revert back to Mashpee. <br /> Kevin: It all depends what law you want to read. A law was just. <br /> quoted, thatis a. guideline from the State Board of Education. <br /> Tom: No, it is the law of the Commonwealth of Massachusetts, Chapter <br /> 766. <br /> Kevin: The Comm. of Mass. authorized the Board of Education to <br /> write guidelines. Those guidelines come within Chapter 766 you <br /> gust quoted. There is another law, which says just the opposite. <br /> It states, "The education is paid from the town of whtbh the child <br /> resides. " So there are two laws which state two differezitLthings. <br /> Tom: I agree, I don't think the Town of Mashpee should. be -respon- <br /> sible for the education of the children of Dare School. <br /> Kevin: A ruling from the State Department of Education is needed. <br /> This will state if Mashpee is respond-ble for the cost of students <br /> who are not residents of Mashpee for their education. Also, in <br /> the:- case of Gomes, I suggest you write the Family Services and <br /> have them put in writing that they are responsible for his education. <br /> Let them be aware of the fact, we have no funds to educate him. <br />
