1yyl
" Selectmen's Minutes - Page
9/12/79
. Continued
Garland still. speaking) They do not have the right to specifically
to nominate any particular, for any particular
salary. That is nay opinion is in the purview
of the Board of Selectmen.
Murphy: -Are you asking that the salary structure be amended?
Garland: No. not at all, All I 'm asking is that the - Town
really reconsider the motion that was made on the
floor. That' s all Im really asking.
McCartney: No. not qui to.
Garland: You cannot legally move to reconsider that article.
At Least this is what I' ve been told. Legally you
cannot move to reconsider that article because of
the town by-laws, , the war you get arouhd it,
precedent has been set, by if such an article, not
at an annual town meeting, is approved at a special
town meeting, then it does to legislation for their
approval. That precedent has been established and
that is the legal route to- go. It was established by
the Town of Braintree.,
Murphy: This is to amend the annual at a special meeting
Garland: Rights To charge the salaries. Because of the town
by-laws lar which stipulate a period of time in which
you can rove - for reconsideration, and that time
limit has long since expired, you cannot at a special
torn meeting move to reconsi-der prior action. Basically,
this is what these two article do in essence, only
its doing it in the legal fashion. The town can vote
t a special town meeting, but thea that vote must
be approved by the legislation. .If it is not approved
by legislation then everything is status quo. If it
approved by the legislation hien its upheld.
McCartney: There is no mention of the third member of the- Board.
You may be recinding the action of the annual. Yet the
third member of the Board
o' Connell: The -third member of the Board would remain the same.
Murphy: If this passes, this is going to double the amount
f money in one year.,
Farland. No.
