Page 1 <br /> Board of Selectmen <br /> Minutes <br /> October 1 , 1994 <br /> Present: Selectman Mills, Selectman Costa, Selectman Dini io <br /> Administrative Assistant Joyce Mason <br /> Absent: Selectman Caffyn, Selectman Vaccaro <br /> Guests: Attorney Elizabeth Lan <br /> Meeting Called to order by Chairman Mills at 630 p.m. <br /> Selectman Bills welcomed Peter Dinio, newly appointed Selectman <br /> to the Mashp e Board of Selectmen. i <br /> APPOINTMENTS S ASID HEARINGS: <br /> Attorney Elizabeth Dane; <br /> Attorney Elizabeth Lane of Kopelrnan and Paige,P.C. was present t <br /> discuss the status of the New Seabury Special Permit with the Board <br /> and interested residents present. <br /> Attorney Lane described the special perrrlit and deed restriction as the <br /> most convoluted and complicated natter she has seen. It is unto itself <br /> indicated Attorney Lane stating that it is difficult to provide simple answers <br /> about the matter. <br /> New Seabury has complied with the requirements for a 20 year extension <br /> of deed r strictions based upon documents provided by the To n. It <br /> was noted that the special permit and deed restriction was initially granted <br /> to New Seabury Company by the Town in 1964. <br /> It is not clear as to whether the special permit and deed restriction exempt <br /> New Seabury from current zoning requirements indicated Attorney Lane. <br /> The dimensional zoning regulations include the size of buildings, setbacks <br /> and lot area coverages. In the former dimensional regulations, there are n <br /> height limitations pertaining to buildings related Attorney Lane. <br /> Mashpee's current zoning bylaws limit the height of buildings to 35 feet <br /> informed Attorney Lane. <br /> Attorney Lane indicated that she has received communication from <br /> the New Seabury Company's attorney with regards to their position on <br /> this matter. As noted, New Seabury has been a "good neighbor„ to the <br /> 'own and has been harmed by litigation in the past. New Seabury f&els <br /> quite strongly that their position is correct indicated Attorney Lane. <br /> New Seabury has indicated that a lawsuit will be filed against the'Town if <br /> l lashpee refuses to allow the company to build homes that exceed the <br /> height requirement of the current zoning bylaw related Attorney Lane. <br />
