a <br /> Page 2 <br /> Board of Selectmen <br /> Minutes <br /> October 18, 1994 <br /> Attorney Elizabeth Lane: <br /> New Seabury was asked if they would voluntarily restrict the height <br /> for its homes in the Seaside development informed Attorney Lane. <br /> After negotiations with New Seabury, the company has indicated <br /> the height for buildings in the Seaside subdivision will <br /> not exceed 2.5 feet indicated Attorney Lane. <br /> The height of 42.5 feet is average grade excluding any widow's walk, <br /> cupola or non-living space noted Attorney Lane. <br /> This is an interim resolution and does not require the Town to concede <br /> to anything indicated Attorney Lane. The negotiated height of 42.5 feet <br /> does not obligate the Building Inspector to approve building permits <br /> for the Seaside subdivision related Attorney Lane. <br /> William Hauck, Building Inspector indicated that three building permits <br /> have been issued to date in New Seabury in the - ' height range. <br /> Documents indicate that 50 of the landowners in New Seabury have <br /> signed affadavits requesting a 2year extension of the special permit <br /> and deed restriction indicated Attorney Lane. <br /> Torn Fudala, the Town Planner asked if New Seabury was required to <br /> obtain signatures from % of the property owners or signatures from <br /> the owners o % of the land mass in Neter Seabury to extend the <br /> special permit and deed restriction. <br /> Attorney Lane indicated that the documents are public records, located <br /> in the Town Clerk's Office. She did not research the signatures on the <br /> afadavits, but assumes that they are valid. Attorney Lane also noted that <br /> she does not know the terms of the condominium units or quarter shares. <br /> Jane Coogan, a New Seabury resident prior to 1964 indicated that she <br /> is unaware personally of any resident who was approached to sign the <br /> affadavit to extend the special permit and deed restriction. <br /> Attorney Lane indicated that her legal opinion was based upon information <br /> provided by theTown. Mr. Fudala noted that the information was provided <br /> to 1lashpee by the New Seabury Company. <br /> 7:26 p.m. PUBLIC DISCUSSION: <br /> Jaynes McGonagle presented a petition of over 300 signatures requesting <br /> the Board televise Selectmen's meeting on the local cable access channel. <br /> Mr. McGonagle indicated that he was present on behalf of the disabled, <br /> housebound and elderly residents unable to attend night meetings, <br />
