The permanent submission must be complete by Wednesday, which means the
process has to start earlier. Chartwell should have a pencil copy by
Monday.
The Committee discussed what to do about this requisition; they could meet
again on January 2nd or 9th ( instead of waiting to Jan. 16th) • Can it be
paid before getting permission to delay prevailing wage filing? Dr.
DeMoura suggesting voting on it today and he can hold it for signatures in
his office and members can stop in to sign it , after Paul has discussed it
with town counsel .
** Paul made a motion to forward to the Selectmen for their approval
and payment $1 , 235 , 462 . to Stone Building Co . , subject to final
verification by Town Council regarding delaying prevailing wage
reporting by 1 month. Merry Sue seconded the motion.
Merry Sue said, if town counsel approves this request, will a deadline then
be established regarding due date of paperwork?
Paul said if Stone does not have the paperwork before the next draw, then
that subcontractor does not get paid.
** All members were in favor 5-0**
Costa spoke about the issue where the mason hired someone at a mason' s
salary and then starting paying them as an apprentice. The subcontractor
thought this person wasn't qualified as a mason but told him he could stay
on as an apprentice .
Paul said it is the Committee ' s responsibility to forward any complaints to
the Selectmen. Paul asked Costa to write a memo to the file on this issue .
Paul explained to the Committee he was unable to talk with town counsel but
he will be asking him to draft a letter to the bonding company, with a copy
to Stone , saying the town is seriously considering revoking the bond. The
Committee can discuss strategy later. Paul has told Jim Vacarro so the
Selectmen would know. Stone has been in non compliance for 6 months . SMMA
has to send a letter out telling them they are still in non compliance.
Paul said the critical work is still not done, the roof, the building is
not enclosed, the stairways are not here . Every time he asks Stone a
question they give 3 weeks as an answer. He has spoken with Alan Scott
about this and he is also extremely frustrated. ,
Bill asked what the problem is?
Jim Byrne thinks it is beyond their ability, they can't get a handle on
this job. Stone is not used to dealing with filed sub bids .
Paul said the major issue is still the steel .
Why is the steel still a problem?
Jim learned that Stone was very close to contracting with Cape and Island
Steel and they pulled out at the last minute and Stone had to begin again.
Jim said Stone ' s credibility has slipped with their subs also .
Tom thinks Stone is also disjointed - they should have an office on the
Cape . They have this job and Falmouth Hospital .
Paul said Stone won' t hire any full time laborers . They have the Super
cleaning the site . They have now blown so much money they can' t be making
a dime on this job.
4
