** Paul made a motion to table payment requisition #8 until Stone <br /> complies with schedule and waiver of liens submission. Merry Sue <br /> seconded the motion. <br /> Merry Sue asked when we will vote on it? <br /> Paul said we may have a meeting before 2 weeks, if not it will wait until <br /> the Feb. 16th meeting. <br /> Joel said you can only return a requisition for arithmetic errors or it is <br /> not in the correct form. Otherwise you have to take action within 7 days. <br /> **Paul withdrew the former motion. ** <br /> ** Paul made a motion to return Stone's 8th payment requisition <br /> because it is not in correct form and not act on it until it <br /> complies with the terms of the contract . Merry Sue seconded the <br /> motion. All members were in favor 5-0. ** <br /> Joel will send Stone notification of why the requisition is being returned. <br /> Tom has asked Alan Scott for the wavier. Alan said until Stone knows the <br /> amount certified, how can they issue a waiver? <br /> Paul responded that Stone has withdrawn the cooperation between the <br /> architect, Chartwell and themselves regarding getting the requisition out . <br /> CONSTRUCTION PROGRESS <br /> Paul explained that the bonding company has hired a consultant , Cashin of <br /> Long Island, NY. Mike Spinelli is flying here tomorrow to meet with Stone , <br /> SMMA, Chartwell and Paul to mediate the problem. It is a non-binding <br /> meeting . He will look to see if any parties are being unfair to the <br /> process . This evaluation will tell the bonding company if the owner is <br /> reasonable and is there grounds for default. It gives the bonding company <br /> a quick idea of what state the job is in. This report will save time if <br /> and when the town does declare them in default. <br /> Paul has spoken with the bonding company - Liberty Bonding Service. If we <br /> declare default, they would look towards 2 solutions : <br /> a. bring in a new construction firm, filed sub bids would be reassigned. <br /> They would try to come to an agreement with Stone' s subs , or if not , get <br /> another company. <br /> B. Talk to the owner, do they think Stone has the technical ability to do <br /> the job but because of administrative problems , couldn' t put it together. <br /> If that is the case, they would put a senior project engineer on the job, <br /> unless Stone was uncooperative . <br /> There would be 1 new person on the job, things would keep going on, no work <br /> stoppage. <br /> The bonding company recommended pulling the bond early. They asked Paul ' s <br /> opinion of where the job was . He told them an entire wing is not closed in, <br /> there is nothing going on for exterior work, and a lot of work needs to <br /> come down in the interior. <br /> Joe asked if it is worth the risk to go with the first option? <br /> Paul has thought about it very seriously for the last 2 weeks . He believes <br /> Alan Scott has the technical ability to do the job. The bonding co . <br /> engineer ultimately would make that call. Would we benefit from Stone <br /> remaining in the loop? Many subs , suppliers, etc. are Stone ' s . The first <br /> thing the new project engineer would do is check every shop drawing. Paul <br />
