t
serve the .interest of the town,
Toni wren said Town Counsel said that stone should be paid.
Jim said that Paul Griffin said the same thing when he called earl 1 er) we
should pay Stone .
Merry sue said she thinks they should be paid, this work goes back to
September.
Tori said that failure of payment is in the contract , despite poor
performance . If you don' t pay, Stone could possibly tarn the tables and
claim the town is in breech of the contract .
Steve said i f this requires a special meeting of this Committee and the
Board of Selectmen, then so be 'it .
Merry Sue said this issue ( of direct claim by plumber) w* 11 not be solved
I
n 1 week.
Bill said that Town Counsel already said to pay it, he will just repeat
that at another meeting .
Ian said we have already dragged our feet on paying this . Any further delay
is giving the contractor grounds against the town.
Torn read the payment responsibilities from the contract : contractor has to
be paid within 7 days of the work being certified by the architect or the
contractor may, in 7 additional days with written notice stop the work.
Janice said the work is severed anyway, we have 350 kids here and the rest
of the school system being effected by this . Our kids are going without
their face-lit , lets get our priorities straightened out.
Steve believes the amount of retainage left after this is insufficient to
complete the job.
Joel said Stone ' s original payment request was $1 . 4 million and that was
reduced to $812 , 000 based on the value of work completed
Janice does not want to face the citizens o f Mash.pee when we find out the
amount withheld is insufficient to get the work done.
Steve said the town is liable for the prevailing gage information,
John Williams said he is concerned if Joel certified the work as done,
Chartwell agrees , the contract says Stone should be paid, then if they pull
people off the job, then who knows when we will get C & D. we are now so
close to getting in.
Janice said she wants Town counsel to tell her, in front of the Selectmen,
to sign this payment .
Steve said how can we be assured that the payments certified have been made
to the subs . If they have not been paid they have a direct 1 ine to us . we
have been told they were paid and they were not. He can appreciate the
architect' s responsibilities , they know the work '.s done but we dont know
who has been paid.
There will be $1 . 7 million remaining but when he adds the figures up we do
not have enough to finish the jobb ,
Jim said the subs know there is a. problem between stone and Mashpee and
3
