MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
AUGUST 14,2015
Mr. Furbusli said that the meeting was advertised in the paper (July 27, 2018 and August
3,2018). Mr. Bonvie asked Mary if these two parties were raising questions at the Planning
Board Meeting about the Zoning Board Articles, why weren't the Planning Board members
at tonight's ZBA meeting to discuss their opinions.
Mary said she thought there were no issues and thought it was going to go through at the
public bearing. She said she didn't' receive any comments ahead of time and received them
at the meeting.
If the issues are not resolved by the time the Planning Board takes a vote on a
recommendation to recommend to Town Meeting or not, those issues will just arise at the
Town Meeting, and conservative voters will vote no. She said they didn't go forward with
it because there were too many questions.
Mr. Furbush asked her if the Board answered her questions tonight.
Mary did not answer. She said Evan Lehrer, Town Planner gave her some information and
material and the purposes of zoning such as to reduce non-conformities instead of allowing
them. She said Evan provided her some case laws.
Mr. Furbush said that's what this Article states; they are not allowing any new non-
conformities.
Mr. Bonvie asked Mary Waygan if she would be willing to put a list together of her
concerns to this Board, and that the Planning Board and Town Planner put together their
concerns, so the ZBA can try and answer those concerns, and hopefully satisfy them and
get them on board with the Article at Town Meeting, Mr. Bonvie said he would like to
have her support.
Mary told the Board, several times, that they have to view the video, of that meeting,to see
what the concerns are.
Mr. Furbush told her that he was at that meeting and would like her to provide what those
issues were. Mary repeated to view the video of that meeting.
Mary said she would like the ZBA to give her a formal response to the comments from the
last Planning Board meeting. She said she will forward the minutes to the Board, she thinks
all the concerns were expressed that night. She also thought that the ZBA withdrew the
article at Town Meeting.
Mary suggested that the ZBA put a letter in writing to the Planning Board, and comment
that if there was anything that hasn't been addressed in the change of this bylaw, so the
Planning Board can read and address it, she will commit to have a public hearing. If there
are any comments that remain that are unresolved, they can be continued to another date.
6
