MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 25, 2018 <br /> Mr. Blaisdell said that he as one member would agree to uphold the Building <br /> Commissioner's ruling, and would allow the Finding with conditions in the motion. Mr. <br /> Blaisdell stated that the Board should not be making rulings on what may or may not <br /> happen in the future. The Board can make conditions. <br /> Chairman Furbush said he is trying to set a precedence and does not agree with allowing <br /> the bathroom. He would not have a problem if the garage was attached to the home. <br /> Mr. Mendoza asked if the applicants plan on heating the space. <br /> Ms. Sangeleer asked if the heating system would sustain the space in the winter time. <br /> The applicants said they plan on heating the space but will drain the system in the winter <br /> and will keep the garage at 50 degrees. <br /> Mr. Pittsley agreed that the space heater is not conducive to a living area. <br /> Ms. Sangeleer read the Inspection Department comments into the record. <br /> Mr. Blaisdell read the Board of Health comments into the record. <br /> There were no comments from Conservation. <br /> Mr. Blaisdell made a motion to approve 401 Monomoscoy Road petitioners Robert and <br /> Donna Roche Trustees request for an administrative appeal to the Building Commissioner <br /> under MGL. Chapter 40A Section 8 and 15. The Trustees are seeking the Zoning Board of <br /> Appeals to overturn the Building Commissioner's decision to allow for construction of a <br /> lavatory in their detached garage. <br /> Mr. Goldstein seconded to approve the request for the Trustees' appeal. <br /> Chairman Furbush polled the Board as the motion to overturn the Building Commissioner's <br /> decision. Mr. Blaisdell, no, Mr. Goldstein, no, Mr. Gould, no, and Ms. Sangeleer, no, and <br /> Mr. Furbush, no. All agreed not to overturn the Building Commissioner's decision. <br /> Mr. Blaisdell made a motion to approve Robert and Donna Roche, Trustees' request to the <br /> Zoning Board of Appeals to grant a Finding and allow for installation of a lavatory in the <br /> detached garage under Section 174-24 K on property located in an R-3 Zoning District, <br /> Map 124 Parcel 64, Mashpee, MA with the following conditions; <br /> 1. Conditioned upon all Town Department comments read into the record. <br /> 2. Conditioned that the garage cannot be finished with a bedroom or any type of living <br /> space. <br /> 3 <br />
