Cook, Jr of 135 West Way, <br /> Mashpee, MA 02649, for an aquaculture license pursuant to G.L. c. 130, §57. <br /> Notice was duly given to abutters in accordance with Massachusetts General Law. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on December 9,2011 a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the application at Mashpee Town Hall on December 19, <br /> 2011. The following members of the Board were present and acting throughout: Wayne <br /> E. Taylor, Michael R. Richardson, Carol A. Sherman, John J. Cahalane, and Thomas <br /> O'Hara. <br /> The Mashpee Board of Selectmen issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 130, §57. <br /> FINDINGS: <br /> 1. The aquaculture grant would be located within the vicinity of the Popponesset <br /> Bay inlet. <br /> 2. The aquaculture grant would be located at least 1,150 feet from the shoreline and <br /> the nearest Mashpee residences. <br /> 3. The aquaculture grant will consist of 1.9 acres of area. <br /> 4. The Mashpee Wampanoag Tribe maintains an existing aquaculture grant located <br /> between the proposed grant location and the residential properties on the Mashpee <br /> shoreline of Poppponesset Bay. <br /> 5. The applicant will be using flexible cages that which will be anchored to the <br /> bottom of the Bay. <br />
