The Shellfish Warden believes that the anchoring methods proposed by the <br /> applicant will prevent the gear and cages from washing onto the shore during a <br /> storm. <br /> 7. Most of the cages will not be stacked and will exist as a single layer along the <br /> bottom of the Bay; however, in the deepest water, the applicant intends to stack, <br /> at most, two cages on top of one another. <br /> 8. The applicant will not be using floating bags. <br /> 9. The cages will be completely under water at mean (average) low tide. <br /> 10. The only visible markers indicating the location of the aquaculture grant will be <br /> buoys marking the four corners and the four sides of the grant area. <br /> 11. The flexible cages being used by the petitioner do not require noisy equipment for <br /> flipping. <br /> 12. The time required to flip the flexible cages is roughly 5 seconds. <br /> 13. The only noise generated from the aquaculture grant would be an electric motor <br /> used to periodically sort the shellfish. This electric motor does not require a <br /> generator and runs off of the applicant's boat battery. This electric motor will not <br /> generate excessive noise. <br /> 14. The applicant represents that, between Memorial Day and Labor Day, he would <br /> only use the electric motor on weekdays after 8:OOam. <br /> 15. The flexible cages are the only method used by the applicant to protect the <br /> shellfish from predators. <br /> 16. The cultivation of shellfish has a positive effect on the Bay. <br /> 17. The Town of Mashpee adopted a Comprehensive Resource Management Plan in <br /> the 1990's. Shellfish grants, such as the one proposed by the applicant, are part of <br /> that plan. <br /> 18. The Shellfish Committee has approved the applicant's grant. <br /> 19. The proposed aquaculture grant will not have any material effect on the value of <br /> any parcels of residential real property located within the Town of Mashpee. <br /> 20. The Waterways Committee has approved the proposed aquaculture grant. <br /> 21. The Waterways Committee has determined, and this Board makes a finding that, <br /> the proposed aquaculture grant will not obstruct navigable waters. <br /> 2 <br />
