The Waterways Committee has determined, and this Board makes a finding that; <br /> the proposed aquaculture-grant will not obstruct navigable waters. <br /> 22. The proposed aquaculture grant will not impair the rights of any person. <br /> DECISION: <br /> After a public hearing and review of all evidence submitted on behalf of, and against,the <br /> petitioner's application,the Board finds that the proposed aquaculture grant will not <br /> impair the private rights of any person or materially obstruct navigable water. <br /> Upon motion duly made and seconded, the Board of Selectmen voted unanimously at the <br /> public hearing on December 19, 2011 to GRANT the petitioner's application for an <br /> aquaculture license pursuant to G.L. c. 130, §57, with the following conditions: <br /> 1. Petitioner must install and maintain eight(8)markers delineating the four(4) <br /> corners and four (4) sides of the grant area(the final locations of such markers to <br /> be determined by the Harbormaster). Maintaining the markers at their correct <br /> locations shall be the responsibility of the applicant. <br /> 2. The grant area must be modified to accommodate a 155 foot setback from the <br /> Inner/South Channel and 100 foot setback from the Town boundary line. The <br /> applicant must prepare detailed drawings to show the grant area GPS or GIS <br /> coordinates. Additional coordinates shall be shown on the applicant's drawing <br /> noting locations of grant area markers. <br /> 3..
