h) Mr. Harrington added Section E(9)(d) due to its absence in the regulation. It was on the <br /> original list of policies that the board wanted to include in the regulation but it was not <br /> on the March 191h printed version. 500 feet was chosen as the distance by the board. <br /> i) Mr. Harrington added Section E(9)(f) so that smoking bars were addressed. He specified <br /> the free-standing buildings due to issues that the Tinder Box caused with Puritan Clothing <br /> in Mashpee Commons. He indicated that the HVAC/ventilation specifications need a <br /> good reference, and stated that he will work with the Building Department to get some <br /> requirements for the design and construction. <br /> j) Mr. Harrington completed Section K by including the exception for the free-standing <br /> displays in adult-only stores. <br /> Mr. Harrington stated that he had not had an opportunity to read all of the information, and <br /> would like more time to review and digest it. He suggested that, if the board wishes to adopt the <br /> regulation at some point, implementation be phased in over several months,orthe effective date <br /> be delayed to allow retailers time to remove and/or sell their existing product. Mr. Harrington's <br /> comments to the CRR letter, and for vaping in general, were that we have no idea what is in the <br /> liquids they make, and that manufacturers and retailers will not take responsibility for the <br /> products they sell. <br /> Monsoor Java of 135 Main Street addressed the board, and raised the question of how to stop <br /> on-line purchases as well as how to stop adults from purchasing/distributing to minors. Mr.Java <br /> suggested that Mashpee have a dialogue with abutting towns regarding tobacco sales. He also <br /> suggested that an award letter or letter of appreciation be given to retailers who remain in <br /> compliance. <br /> Stacey Schakel, nurse at the K.C. Coombs School, introduced herself and stressed the need for <br /> and importance of parent education on tobacco and vaping. <br /> There being no further comments, Laurel Almquist made a Motion to schedule a public hearing <br /> to continue discussion on the Draft Tobacco Regulation. Motion seconded by Brian Baumgaertel. <br /> VOTE: Unanimous (2-0). <br /> NEW BUSINESS <br /> 1. There were no Expense Warrants to sign. <br /> 2. There were no Meeting Minutes available for approval. <br /> 3. Request for 2018 Farmers Market—Mashpee Commons. Glen Harrington stated that,for several <br /> years now, Mashpee Commons has requested a weekly inspection/permit fee rather than having <br /> the BOH charge each vendor$50.00 individually each week. The board has approved this request <br /> annually and Mr. Harrington recommended that the board issue approval again this year with the <br /> same set of conditions: <br /> a. Rory Eames is considered the certified food manager to oversee the food vendors <br /> operations during the event, per 105 CMR 590.009(C). <br /> b. The fee for the market is $100.00 per week.
