MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 22, 201.8 <br /> Mr. Borselli said that this application meets the Zoning Bylaw requirement, there's no <br /> variance requirement. It's a Special Permit application to be crossing 85 ft. of wetland, if <br /> it were 25 ft. away it would be a Special Permit request for 105 ft. <br /> Mr. Goldstein read the Conservation, Shellfish Constable, Board of Health and Inspection <br /> Department comments into the record. <br /> Associate Member, Sharon Sangeleer read the Harbormaster comments into the record. <br /> There were no more comments from the Board. <br /> Chairman Furbush asked the audience if they had any comments. Two residents spoke but <br /> were not listed on the abutter list. <br /> Mr. Furbush asked Mr. Borselli what is the adequate distance allowed between docks. <br /> Mr. Borselli said that the docks would be approximately 100 ft. apart. Docks all along <br /> Great River are much closer together. The distance between two docks is approximately <br /> 30 ft., and is plenty of space to maneuver a boat with an 8 to 10 ft. beam. <br /> The Board had a conversation regarding following proper certified abutter list mailing <br /> procedures. <br /> Mr. Borselli said he absolutely sent out the abutter list certified, or he would not have <br /> received an order of conditions. The new Conservation regulations about docks were <br /> initiated on July 26, 2018 and have no bearing on either person's ability to have a dock. <br /> Mr. Isam Hijaze, an abutter received notification and supports the project. <br /> Ms. Linda Sarkisian, an abutter received notification and opposes the project. <br /> Mr. Whitney, the homeowner, said he met with the Harbormaster, the Shellfish Warden, <br /> and Conservation Commission who asked him to relocate the dock. Conservation has the <br /> original plan. Mr. Whitney said that he is presenting the 70 ft.,the 25 ft. plan is something <br /> he will be working on for the next process. <br /> Chairman Furbush would like to condition that he.receive a detailed comment from the <br /> Conservation Agent. <br /> Mr. Bonvie made a motion to issue a Special Permit to 21 Metacomet Road, LLC care of <br /> NJCJ LLC at 21 Metacomet Road. <br /> 1, The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 7 <br />
