Conditioned upon all Town Department comments read into the record. <br /> 4. Conditioned that the applicant obtain evidence that he or she made application to <br /> the Conservation Commission depicting a 25 ft. setback and was asked by the <br /> Commission to locate the dock closer to the property line at an existing location <br /> which is approximately 10 ft. from the property line. This can be depicted in either <br /> the minutes or a letter from the Conservation Agent, and shown to the Zoning <br /> Enforcement Officer of this community. <br /> Mr. Pittsley seconded, yes, Sharon Sangeleer, yes, Mr. Goldstein, yes, and Mr. Forbush, <br /> yes. All were in favor of the dock project. <br /> 20 Linden Road: Owner, Richard E. Hawryluk requests a Special Permit under §174- <br /> 45.4 of the Zoning Bylaws to allow for an accessory apartment on property located in an <br /> R-5 Zoning District, Map 28 Parcel 63, Mashpee, MA. <br /> Mr. Richard Hawryluk, the homeowner represented himself for the request. He started the <br /> project quite a few years-ago but could not get it finished in time. He has a free standing <br /> weather tight building ready for electrical and plumbing. When he first started the project, <br /> it was an accessory building without a kitchen, when he reapplied the Building <br /> Commissioner suggested that he might as well apply for a full apartment. He also had to <br /> remove a bedroom in order to satisfy the Board of Health, which was already completed. <br /> He had a three bedroom house and turned it into a two bedroom house. His plan depicted <br /> a darkened area which is a deck between the two buildings and is shown as attached. He <br /> received a Building Permit and started the project in July, 2003 when the bylaws were <br /> different. <br /> Mr. Furbush went through the bylaw requirements for the accessory apartment, item by <br /> item. <br /> Mr. Mendoza stated that the bylaws were different back in 2003 when this project was <br /> started but the permit lapsed, and that's the reason for the Zoning application. <br /> The Board asked the applicant if he has a driveway. The applicant said he has enough room <br /> for six cars. The plan does not depict a driveway, so the Board had the applicant draw the <br /> line on plot plan depicting the driveway and initial the plot plan. <br /> Mr. Mendoza asked the Board that a condition be made that the Fire Department reviews <br /> the plans for smoke detectors. <br /> 8 <br />
