14 <br /> Board of Selectmen <br /> Minutes <br /> August 27, 2018 <br /> Review of Draft October 15, 2018 Annual Town Meeting Warrant: (continued) <br /> Article #10: Zoning Bylaw to limit the number of Marijuana Retailers and the location of <br /> Marijuana Establishments. Mashpee currently has (9) retail off-premises alcoholic beverage licenses. Twenty <br /> percent (20%) of the (9) licenses is L8. This would presently equal (1) location for the Town of Mashpee to <br /> allow the siting of a marijuana retailer. If the number of off-premises sale of alcoholic beverages should <br /> change, the number of allowed marijuana retailers would also change. <br /> In concern to the Mashpee schools, Mary Waygan requested a buffer zone be considered for the siting of a <br /> retail establishment. In response, Evan Lehrer stated there is a mandated 500' buffer zone from the schools. <br /> A colored map would detail the proposed commercial/industrial areas, and locations of the schools. <br /> The proposed Bylaw amendment would restrict a Marijuana establishment use to the Commercial (C-1, C-2 or <br /> C-3) or Industrial (1-1) Districts upon issuance of a special permit. <br /> The article was HELD for additional clarification. <br /> Article #11: This Bylaw amendment would establish the penalties for violating the Sign Bylaw. An <br /> amendment to the draft article would impose a fine per sign for the second, third and subsequent offense to <br /> enforce fairly and consistently. Currently,there are no penalties for violating the Zoning Bylaws regarding <br /> signs. The article was HELD pending a recommendation from Town Counsel. <br /> At #12: To allow certain types of temporary signage to be displayed within a specific timeframe during <br /> the summer season; March 1 through October 15"'. Failure to remove signage shall result in a fine of$50 per <br /> day, for each sign. <br /> Mary Waygan, Planning Board recommended the signage be amended to reflect the time period; <br /> June 15`x'to October 15t". Ms. Waygan also suggested that under §174-57A 3. Other Signs, be specified. <br /> The article was HELD pending a recommendation from the Planning Board. <br /> Article 413: Form Based Code _ The article was HELD for additional review. It was disclosed there is no <br /> proposal from Mashpee Commons, LLP with respect to this article. Petition Article #23 duplicates this article. <br /> Motion made by Selectman Gottlieb to convey to the Planning Board, there will not be a proposal <br /> from the proponents for a form based code, therefore, this article is premature. <br /> Motion seconded by Selectman Cotton. <br /> VOTE: 3-1. Motion carries. <br /> Roll Call Vote: <br /> Selectman Sherman,yes Selectman Gottlieb, yes Selectman O'Hara, no <br /> Selectman Cotton,yes Opposed, (1) <br />
