Haney requests an Administrative
Appeal to the Building Commissioner concerning a cease and desist of a heliport under
§174-17, §174-22 and §174-25 of the Zoning Bylaws on property located in an R-3 Zoning
District, Map 99 Parcel 40-0, Mashpee, MA (Owner of record: Mary E. Zocchi).
(Continued front August 22, 2018 hearings at the request of the Attorney).
Attorney Brian Wall represented the petitioners. He said at the last continued hearing, the
Board had received an opinion from Town Counsel who advised the Board to deny the
petition of the Building Commissioner's decision, but also suggested that his client might
consider filing for a finding or a special permit. Mr, Wall consulted with his clients and
determined that he will file either a finding or special permit for the helipad, and operation
thereof. He therefore is asking for a continuance until the hearings on November 14, 2018
to address the matter of the appeal, and the request for the special permit. He wants to
preserve his client's rights and keep the appeal matter open.
Chairman Furbush questioned if the request for a finding is denied, does that make the
special permit null and void?
i
