MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
SEPTEMBER 26, 2018
Mr. Mendoza addressed the Board stating that Christi met with Plan Review department
head members on September 18,2018 who asked her specific questions about the operation
of her business. There were separate comments from each department head such as the
DPW Director stating that the dogs are not allowed in the back of the park area.
Mr. Mendoza mentioned that the building already has a Special Permit for this type of
"use", and that's why he suggested the Board discuss this to confirm that fact. He felt the
Board needs to be involved, and he does not see any negative impact. He made a
recommendation to the Board to allow this type of business because the use is similar under
the existing Special Pen-nit already at this building.
Mr. Furbush reviewed the details with the Special Permit with the applicant. He was
concerned about the overnight stay mentioned in the meeting minutes by Board of Health.
Christi said that the overnight boarding is not her primary business, but if a client requests
overnight boarder training she would like the ability to keep the dog and train it herself or
have one of her staff members assist her. She also said she will not be living there.
Mr. Blaisdell mentioned that the Building Commissioner can allow this permit without her
having to apply with the Zoning Board.
Mr. Mendoza said; correct. He has to give the applicant an occupancy permit and can list
specific items on the occupancy permit as the existing Special Permit based on the input
from the Board. For example; no permanent overnight stay, or other reasonable requests.
Mr. Mendoza explained to the Board that the Special Permit use is allowed at this building,
and this is a similar use of space in that building.
Mr. Furbush and Mr. Blaisdell both agreed to allow the applicant to proceed as long as the
items and concerns mentioned at the Plan Review meeting are listed by the Building
Commissioner.
Mr. Furbush said that there is no need for the applicant to apply for the Zoning Board.
Mr. Goldstein made a motion that the Board allow Christi McKeen, at 46 Nicolettas Way
Unit 10, to move forward with her business under the same Special Permit (SP-2012-59),
and allow the Building Commissioner to issue an occupancy permit for the same conditions
that were stated at Plan Review dated September 18, 2018 by the Town Officials.
Mr. Blaisdell seconded, yes. All were in favor to allow the Building Commissioner to issue
an occupancy permit to Christi McKeen for her dog business at 46 Nicolettas Way, Unit
10.
3
