The Chair asked for a motion to reschedule the next meeting for October 16, with an option to <br /> also call a meeting on the 23"d if needed. <br /> MOTION: Mr. Willard made a motion to schedule meetings for the 16", and 23,d. Mr. <br /> Abbott seconded the motion. All voted unanimously. <br /> Mr. Terry asked to be recognized on behalf of South Cape and inquired whether there had been <br /> consideration to place the project on Lot C. The Chair responded that the feasibility study <br /> suggested that Lot C would not be environmentally feasible due to necessary DEP set asides or <br /> desirable, due to potential abutter. Mr. Terry inquired about whether the Committee had <br /> received feedback from the abutters and the Chair suggested that if Mr. Terry wished to present <br /> feedback from those abutters supporting the use of Parcel C, the Committee would reconsider it. <br /> Mr. Abbott reported that there were two neighbors who had been in contact with the Committee, <br /> adding that the feasibility study indicated that Lot C not be developed. The Chair confirmed that <br /> there were significant cost and environmental complications to use Lot C for development. Mr. <br /> Abbott also referenced the required DEP 70% set aside, adding that Lot C was the largest parcel. <br /> Mr. Terry asked for statistical figures on the parcels.and Committee members responded that the <br /> consultants made their recommendations based on their feasibility study which recommended <br /> development of Lots A and B, setting aside Lot C. Mr. Terry stated that South Cape was not in a <br /> position to go along with the development of Lots A and B and the Chair responded with his <br /> hope that South Cape would be involved in the development process and that there would be a <br /> way to mitigate South Cape's biggest concerns. Mr. Abbott suggested that it was possible that <br /> landscaping mitigation may be an option to resolve some issues. The Chair assured Mr. Terry <br /> that South Cape would be involved in the conversation. <br /> Mr. Terry inquired whether the Committee had considered how long a legal challenge would <br /> take in the process. The Chair responded that building permits would be extended in cases of <br /> lawsuits. Mr. Terry asked what the Committee had offered South Cape but the Chair responded <br /> that there was no project yet to discuss until a developer was identified through the RFP process. <br /> Mr. Terry referenced his involvement with various boards and committees in Mashpee and <br /> questioned whether the Affordable Housing Committee had fulfilled its obligations regarding the <br /> Opening Meeting Law, to which the Chair absolutely confirmed that Open Meeting Law <br /> requirements had been met. Mr. Terry suggested that it had already been determined not to use <br /> Parcel C and the Chair responded that the consultants advised that Parcel C be used as a set <br /> aside, which was discussed in the consultant's presentation. The Chair inquired whether Mr. <br /> Terry had received a copy of the feasibility study, adding that potential developers would be <br /> receiving a copy of the feasibility study with the RFP. Mr. Terry inquired whether, if the 70% <br /> set aside was wrong, would the Committee reconsider development on Parcel C, to which <br /> Committee members responded that they would consult with Horsley Witten. With further <br /> questioning from Mr. Terry, the Chair noted that crossing the river bed would create additional <br /> costs to the project, stating that calculations were likely made by the consultants as they drafted <br /> their report. The Chair offered to provide a copy of the feasibility study. Mr. Terry stated that <br /> the study was advisory and the Committee could do what they wanted and the Chair responded <br /> that the study would be incorporated into the RFP for developers to determine their own <br /> proposals for the site. Mr. Abbott noted that Lot C was set aside as open space due to the eastern <br /> side being located in the ground water protection area. Mr. Terry again stated that he wanted to <br /> 5 <br />
