Conservation Commission Minutes f May 9, 2013 Public Hearings M shpee Town Mall — Ockway Meeting Room Commissioners: Chairman John Fitzsimmons, Vice Chairman Ralph Shaw, Brad Sweet and John Rogers Staff Present: Drew McManus (Conservation Agent) and Iris Carpenter(Administrative Secretary) Call Meeting To Order: 5:55 pry The meeting was called to order with a quorum by Chairman F14simmons at 5:55 pm. There was no public comment. Pre/Post leaning An n Ja: 1 Minutes: Approval of the following minutes: April 11, 2013 Minutes approved by unanimous vote of the commission 2 Arneri erp Week c ante: Agent updated the commissioners on the latest information for Americorp week 2013. Discussion of projects and schedules 3 Request motion to amend catch up volume for Tidewat h (volume owed starts from 1995, not 1992L. Finalize Enforcement Order Ian I The agent clarified that the catch up volume of nourishment owed by Tidewatch Condos started in 1995 and not 9993 as originally interpreted. Enforcement Order language for 43-1166 was finalized. Commission voted to approve changes. 4 Billie and David Ka - Recognition of donation to the Mash ee Conservation Dept. The ant wished to recognize the donation of$399 to the Conservation Trust Fund from David an Billy Kapp. The commission recommended a certificate of recognition. 5) Mash ee Wildlife Refuge-e: ro o ed prescribed burn town owned lands)- Toren Ea le. Torn Eagle SF WS explained the next steps in place for prescribed burning and fire break creation at Jehu Pond Conservation Area. Most work will take place on federal and state lands with a few breaks to be created on town owned land within the refuge. No commission vote,just information given. 6) Enforcement: 37 Frog Pond Close: vista runin Jack Vaccaro spoke to the commission regarding the unperrnitted vista pruning that.has taken place at 37 Froggy Pond dose. The homeowner claims he was given verbal authorization for the pruning back in the early Bos from the Conservation Dept. The Agent could not find any corroborating evidence to beck p the homeowner's claim, nor is there any documentation that world provide some sort of evidence.of authorization. The agent informed Mr. 1 acarro to have his client file for a N01 for continued vista pruning with the proviso that official corridors must be located in the field and represented on a plan of record. The homeowner must follow the most recent vista pruning protocols in the Chapter 172 Wetland Bylaw.
