<br /> 22. In the event that a Superseding Order of Conditions is issued following an appeal filed pursuant to M.G.L.-
<br /> Chapter 1.31, sec. 40, this Order of Conditions issued pursuant to Chapter 172 Jf the Mashpee Code shall
<br /> be considered amended to include all conditio ns'of said Superseding Order. Notwithstanding the
<br /> preceding, all special conditions protecting the wetland values-of Chapter 172 shall remain in effect unless
<br /> modified by an Order amending said conditions. The Mashpee Conservation Cqmmission reserves the
<br /> right to require (in the event of the issuance of a Superseding Order by DEP) anlAmended Order of
<br /> Cohdition's if it-deems such"h6cessa'ry fdr'clarification-and/or protection of the'w0and values of Chapter
<br /> 172.
<br /> 23. Special Condition(s)2, 3, 4, 9, 14, 15, 18, 20 &21 shall extend beyond the CertiIcate of Compliance(in
<br /> perpetuity) and shall be referenced in all future deeds to this property. i
<br /> 24. Upon completion of this project, the applicant shall submit the following to the Conservation Commission to
<br /> receive a;Certificate of Compliance: !
<br /> I
<br /> a. A form requesting a Certificate of Compliance. !
<br /> b. A written statement form a registered professional engineer of the CommonV ealth certifying that the
<br /> work has been conducted as shown on the plan(s) and documents referenced, and as conditioned by
<br /> the Commission.
<br /> c. The Commission reserves the right, before issuing a Certificate of Compliance (should items (a) and
<br /> (b) be deemed insufficient and/or in effort), to require.an"as-built" plan prepared and signed and
<br /> stamped by'a registered professional engineer or land surveyor of the ComMonwealth.
<br /> 25.This Order shall be.valid for three years from the date of issuance but may be extended for one or more
<br /> additional periods of up to three years. i
