Talbot pointed out that <br /> the performance standards were the only items regulated and involved the four ways in which <br /> nitrogen fertilizer caused damage to include, application at the wrong time of the year(Oct. 30- <br /> Apr. 14), direct application to imper ous surfaces, application during heavy rain.events and <br /> application near waterways and resource areas. Mr. Talbot pointed out exemptions and a list of <br /> alternative nitrogen sources to be used and referenced enforcement possibly provided by the <br /> Conservation Commission for water resource areas and the Board of Health for other <br /> performance standards. <br /> Selectman Cahalane recommended that the Committee consider presenting the bylaw for the <br /> October Town Meeting. 1&. Talbot agreed. It was suggested that the issue of enforcement <br /> needed to be finalized. There was discussion about the possibly of issuing warnings only for the <br /> first year of implementation, allowing the Board of Selectmen to determine whether fines would <br /> be enforced in the second year. lir. York recommended warnings at the discretion of the <br /> enforcement agency. <br /> Mr. Theis inquired whether the Cape Cod Commission estimates would be part of the bylaw and <br /> whether it could be a liability_ Mr. Talbot pointed out the need to show to the state or federal <br /> government that Ma hpee has made every effort to 'improve water duality. There was agreement <br /> that it was beneficial that Falmouth had overwhelmingly supported their bylaw and that it was an <br /> improvement over the Cape Cod Commission regulation. Mr. Talbot pointed out the document's <br /> use of recommendations and C�should," to encourage best practices with a focus on education and <br /> regulating the performance standards. <br /> Selectman C hala.ne 'Inquired about the response from landscaping firms. Mr. Talbot indicated <br /> that some companies would want to be allowed to fertilize in December and March, though <br /> fertilizer should not be applied until the time of heavy forsythia bloom. In addition, it may be <br /> problematic for properties located within 50 Beet of water,though Mr. 'Talbot pointed out that <br /> alternatives could be utilized in those areas. <br /> �-. Talbot indicated that he would reach out for comments about the drab and discuss the draft <br /> with the Board of Health. Selectman Cahala a will report to the Board of Selectmen that the <br /> bylaw was in its final draft review and would be targeted for the October Town Meeting.
