This is actually out of the main channel and meets the 2
i de l i nes . Dr . He nd l r *s engineers redesigned this and he
will go along with it ,
The Harbormaster would be in favor of this , 'f he has a 17
foot Whaler there ; he would not be in favor of the 29 foot .
He can regulate this . If this is drawn out and there is a
law suit , we will not win . He would approve this with the
Whaler .
Dr . Gordon stated this is assuming the neighbor goes along
with this .
Mr . Ho e er stated he needs a variance from Board of Appeals
because he is less than 25 feet from the property line .
The Harbormaster stated he also would be in favor of
shortening the float from 20 feet to 15 feet; that is more
than enough to tie up a 17 font Whaler
Dr .. Gordon stated the dock is not the problem , per se , unless
the channel roves that way . If the channel, roves towards
land and there is no sand there , then it could be a
s gnificant impediment . This is the most fragile area of
has tepee , from a sand movement standpoint .
Mr . Silver asked what the extent of liability would be
should something happen .
As an advisory Commiession , zero..
Dr , Gordon would like to write a letter to the Board of
Appeals to discuss the accident Potential , gas spills ,
safety , swimming , velocity flow and that it can be a hazard
to navigation .
Mr . Homeyer stated Board of Appeals may not have ,jurisdiction
over those issues .
Mr . Fordham stated if the Harbormaster approved it , he would
o along with him . Mr . Ellis added he approved a 17 foot
boat .
VOTE : Motion rade and seconded that the Waterways Commission
write a letter to the Board of Appeals and/or Chapter
1 and the Array Carps to state concerns about allowing
a dock on the Hendler property . These concerns would
involve hazards to navigation , relative high velocity
in the area , it is a swimming areco. , it is a primary
boating access for at least 150 boats and there is an
accident potential in this very fray le area .
Motion carried .
r F-;a l, Pointed oud s wimm,in t. . a]* n-11- the
