SOUTH CAPE BEACH <br /> JULY 23,9 1996 <br /> PAGE FOUR <br /> Iv DISCUSSION of to ACRE SITE, <br /> Morris explained that Nick Vontzalides had made the statement that under <br /> the terms of the December, 1990 Agreement, no-thing could happen until the <br /> New Town Beach was either accepted or rejected by the Town. It has been <br /> rejected, but there is still a four year period remaining. <br /> M. Kirsner stated that he disagreed with Nick's opinion. He has researched <br /> the Agreement and read it over very carefully and found that the Ten Acre <br /> Site was especially reserved in that agreement. In Nor. Kirsner's opinion, <br /> DENT is under a firm, unconditional obligation to go forward on that; -o, <br /> e will proceed. Mr. Kirsner suggested that he would establish a meeting <br /> with Nick, and perhaps with the Commissioner, in Ma hpee so that all com- <br /> mittee members can be present, so that the committee can begin to mere for- <br /> ward on that -particular issue. <br /> M. Kirsner continued, that should include the improvement of the Access <br /> Road. The Agreement further states, "The State will make every effort <br /> through the Legislature to try to accomplish transfer of legal title t <br /> the Town of Mashpee of this area of land. If, in the event that does not <br /> succeed, in such case the' State or DENS will execute a lease for 99 years <br /> for $1.00 to the Town of Mashpee." <br /> Morris stated that he will go forward as indicated. <br /> Bill Martiros brought up that he would like to discuss at some future meeting, <br /> the Dead Neck Handicap Access Road. Since that was part of the Agreement for <br /> the committee to provide access to handicapped citizens. Bill stated that <br /> Christine Gault was under the impression that that access had to be kept closed <br /> for the whole steer season, which would be the time when the handicapped would <br /> want to use it. That is a controversy that should be resolved. <br /> Chu. Kirsner stated that we will discuss that in depth at the next meeting. <br /> Morris explained, relative to the By-Laws, those recons are in a warehouse and <br /> he has ordered all of them. If he is able to get hold of thein, he will pass on <br /> copies to all of the members. <br /> hm. Kirsner explained that it is part of the 1951 Agreement that the Agreement <br /> becomes part of the Act. we have, as far as I know, legislative existence. We <br /> are the only committee in the nation that exists in that sense, legislatively. <br /> In order to have the committee removed, they would have to file a motion to <br /> amend, and they are not likely to do that. <br /> Having no further business before it, the meeting adjourned at 89.00 p. m. <br /> espectfully submitted, <br /> a <br /> Barbara Gannon <br /> Board Secretary <br />
