This was never mentioned in the past.
Mr. Sullivan said that the garage bathroom will be tied into the existing septic system..
There's only one septic system.
Mr.Dan Oj ala, with Down Cape Engineering had a comment that without heat there cannot
be a bedroom.
Mr. Furbush read the Conservation comments into the record.
Sharon read the Inspection Department comments into the record.
The Board wanted clarification regarding the building permit for the garage and when the
construction started. They also wanted to know if the original plans depicted the bathroom.
Mr. Sullivan said he was informed by his builder that the project would require a ZBA
filing. He was not involved in the permitting process at all and had his builder handle the
submittal for hire.
Mr. Mendoza addressed the Board and stated that the applicant has a permit on site to
construct the garage. The reason this application is in front of the ZBA is for an
Administrative Appeal, is regarding having a full bathroom and shower on the second floor
of the garage and if that doesn't succeed then the next step as he mentioned to the applicant
when they met is that the Board makes a determination for a Written Finding.
Mr. Gould asked the applicant if it would matter to him if he leaves out the shower. Mr.
Sullivan said he would rather keep the shower.
There were no more comments from the audience or the Board.
Mr.Bonvie made a motion to approve the Administrative Appeal to E.Michael and Arlene
Sullivan Administrative Appeal of the Building Commissioner's Decision under M.G.L.
Chapter 40A §§8.and 15 concerning construction of a lavatory in a detached garage on
property located in an R-3 Zoning District, (Map 125 Parcel 256), Mashpee,MA.
6
