MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RCA Electrical Contractors <br /> {Owner of record: Evergreen Energy, LLC) <br /> 588 Main Street(20 Evergreen Circle) (Map 19 Parcel 10-2) <br /> Mashpee, MA 02649 <br /> SP-2018-48 <br /> Dan Ojala, with Down Cape Engineering explained that he met with the Design <br /> Review committee regarding the parking. He said that he is very careful with keeping the <br /> entire front yard setbacks. The site plan shows that the parking is located on the side of the <br /> building. <br /> Chairman Furbush questioned why there are two buildings on one lot. He said he <br /> spoke to tie Building Commissioner, and was told it is allowed on a commercial property. <br /> He had concerns if in the future the owners decided to lease the building, what would <br /> happen to the parking situation. <br /> Mr. Bonvie asked the Building Commissioner if the building has to remain one use <br /> and one tenant. <br /> Mr. Mendoza said; yes the use has to remain with the one tenant. The smaller <br /> building is used for storage and is an (S 1 use group), which means it's an accessory <br /> building to the main building. If the use changes under the current bylaws, it would require <br /> a new application with Design and Plan Review to address all the issues with parking, <br /> signage,etc. Both structures would require a certificate of occupancy; on the main building <br /> it will be clearly stated on the certificate of occupancy. The storage building is an S 1, and <br /> that will be noted on that certificate. The Board can make a condition stating if the change <br /> is from a storage facility to a different use group, it would require to go before the various <br /> boards and committees. <br /> Mr. Gould asked what chemicals will be stored. Mr. Ojala said there are small <br /> generators and synthetic oil only. There is no hazardous materials. <br /> Mr. Mendoza said that both under the Building Code and NFPA, and the Fire <br /> Department would be made aware if there are any hazardous materials. <br /> Mr. Bonvie made a comment to the Board to make sure Charles Rowley reviews <br /> the application and plans. Attorney Lawler said he will make sure that Charles Rowley will <br /> be paid. <br /> Mr. Mendoza said that the Board has the ability to condition that Charlie Rowley <br /> is involved in this project. <br /> Sharon Sangeleer read the Inspection Department, Board of Health and <br /> Conservation comments into the record. Mr. Furbush read the Design Review, and the <br /> Town Planner comments into the record. <br /> 2 <br />
