Hawryluck requesting <br /> a Special Permit under§174-45.4 of the Zoning Bylaws to allow for an accessory apartment <br /> on property located in an R-5 Zoning District, at 20 Linden Road, Map 28 Parcel 63, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 27, 2018 and August 3, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 22, 2018 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Board Members, Ron Bonvie, Scott <br /> Goldstein, Norman J. Gould, and Associate Member Sharon Sangeleer. Also present was <br /> Building Commissioner, Michael Mendoza, <br /> Mr. Richard Hawryluk, the homeowner represented himself for the house project. <br /> He pulled a building permit quite a few years ago but could not get it finished in time and <br /> the permit lapsed. He has a free standing weather tight building ready for electrical and <br /> plumbing inspections. When he first started the project, it was an accessory building <br /> without a kitchen. When he reapplied,the Building Commissioner suggested that he might <br /> want to apply for a full apartment. He also had to remove a bedroom in order to satisfy the <br /> Board of Health requirements. He had a three bedroom house, and turned it into a two <br /> bedroom house. His plan depicted a darkened area which is a deck between connecting the <br /> two buildings. The original building permit was issued in July 2003 when the bylaws were <br /> different and he is now asking the Board to grant him a special permit to complete his <br /> project. <br /> Mr. Furbush went through the Bylaw §174-45.4 requirements for the accessory <br /> apartment item by item. <br /> 1 <br />
