4 <br /> Community Preservation Committee <br /> Minutes <br /> November 8, 2018 <br /> Applicant: Neome Hollis and Pamela Tavares - Proposal Title: Land in Town's ast Five-Year <br /> Action Plan to Acquire 9 Quashnet Road - $161,900: <br /> The Community Preservation Committee agreed to reconsider the application of Neome Hollis <br /> and Pamela Tavares proposed to fund the acquisition of property located at 9 Quashnet Road, <br /> Mashpee identified on Assessor's Map 44 as Parcel 11. <br /> The project and its application were recommended by the CPC and approved by the voters at the <br /> May 2015 Special Town Meeting for $170,000. Funding was appropriated from the CPC Fund <br /> Budgeted for Appropriation Reserve. The property is comprised of 4.212 acres on a small fresh <br /> water pond for open space and passive recreation purposes. <br /> Adhering to the application provision regarding the enforcement of the sunset clause for specific <br /> appropriations, it was determined the project approved in May of 2015 has exceeded the (3) year <br /> span from the commencement of the fiscal year. Therefore, it was requested the applicant re- <br /> apply for CPA funding if it is so desired. <br /> The property is within the 5-Year Open Space Action Plan for acquisition for the protection of, <br /> and access to, Washburn Pond, for agricultural preservation and for protection of designated <br /> BioMap core habitat. There are no structures on the property. <br /> It was noted there has been difficulties with unknown heirs, and the matter of clear title remains <br /> unresolved. CPA funding for this project remains encumbered. The current application requests <br /> $161,900,the current appraised property value. An appraisal of the subject property was funded <br /> by the CPC in October of 2014. The opinion of value was $265,000. The CPC may consider a <br /> new appraisal although it has not been determined. <br /> The inclusion of a new Town Meeting warrant article in May of 2019 if agreed upon would <br /> consider language to authorize the Town of Mashpee to acquire this property by purchase or by <br /> eminent domain. With heirs unknown, the Town has the ability to exercise a friendly eminent <br /> domain taking. <br /> When asked if clear title could be achieved in one or two years, the applicant, Pamela Tavares <br /> indicated she has made unsuccessful attempts to secure clear title. A brief discussion followed <br /> regarding the potential to negotiate a lower price for this property, and it was determined Town <br /> Counsel would be consulted with respect to this regard. <br />
