Approve Board of Health Meeting Minutes. There were no meeting minutes for approval. <br /> 2. Sign Expense Warrants, Board members signed the expense warrant. <br /> 3, Annual Animal Inspectors Report. Mr. Harrington stated that the Assistant Health Agent,who is <br /> also the state-appointed Animal Inspector, had conducted the annual barn inspections. There <br /> were no animals observed that had any communicable or infectious diseases,and the report was <br /> very well done. Mr. Harrington indicated that the timing of this Inspection made it a good <br /> opportunity to revisit the Poultry Regulation. <br /> 4, Title V Violation,7 Greensward Circle. Mr. Harrington stated that an order letter was sent to the <br /> property owners in November 2017 in regard to the number of legal bedrooms. The problem <br /> came up during the property transfer septic Inspection, The property was transferred with the <br /> new owner's representative, Attorney Scott Joseph, aware of the violation. The property is in . <br /> Zone II;and is restricted to three bedrooms. A storage area was being used as a fourth bedroom. <br /> In March 2018,a second order letter was sent to the new owner's and to Attorney Joseph,which <br /> Included$16,000 in fines. Attorney Joseph responded that a deed restriction had been recorded <br /> at the Registry;however,it was never signed off by the Board of Health prior to recording and the <br /> Board never received a copy. The deed restriction was recorded in January 2018 and a copy was <br /> provided to the Board of Health in March. At that time,the new owners also agreed to have the <br /> door opening to the room modified prior to their seasonal use. To date,the opening on the extra <br /> bedroom has not been documented to be in compliance. Mr. Harrington recommended this be <br /> sent to Town Counsel, and that the two attorneys be requested to work it out, after the Board <br /> reaffirms the fines for non-compliance. <br /> Laurel Almquist moved to refer the matter of the Title V Violation at 7 Greensward Circle to Town <br /> Counsel, and to adhere to the $16,000 in fines currently imposed for failure to comply. Motion <br /> seconded by Mallory Langler, Laurel Almquist moved to amend the Motion to Include a reference <br /> to the March 6,2018 Order Letter Imposing the $16,000 in fines. Motion seconded by Mallory <br /> Langler. VOTE: Unanimous(3-0). <br /> 5. Application for Tanning Salon, lob Falmouth Road,Planet Fitness. Mr. Harrington stated that a <br /> request for a tanning permit for the new Planet Fitness had been submitted. Planet Fitness took <br /> over the former Blast Fitness location. The applicant had Informed Mr. Harrington that they will <br /> not Initially use the tanning beds as they are planning on a major remodel of the facility. Mr. <br /> Harrington advised them that an inspection must be done now in order to issue the permit, and <br /> another inspection will be performed after the remodel takes place. Ms. Langler noted that Blast <br /> Fitness had filed bankruptcy and asked If they had paid all their outstanding fines. Mr. Harrington <br /> stated that he would check on that. Chairman Baumgaertel asked if the fines would be <br /> transferrable to the new owner and Mr. Harrington said they would not. Mr. Harrington stated <br /> that Planet Fitness does plan to insulate the walls to control moisture,which has been the major <br /> problem at the site. <br /> Mallory Langler moved to approve the Tanning Permit for Planet Fitness with the condition that <br /> an inspection be performed prior to issuance of the permit, Motion seconded by Laurel Almquist. <br /> VOTE; Unanimous(3-0). <br /> 3 <br />
